  • I too have received the standard letter regarding safety shortcomings.
    They incorrectly (and typically it seems) only mentioned one of my flights on their letter (i am claiming for both the out and return flights in the same booking as both were delayed).
    In my last letter i mentioned i reserved the right to proceed with legal action without prior notice if i didn't get a reply within 14 days.
    Seeing as they did reply in that time frame i feel the next step is to contact them, requesting evidence in the form of the letter posted on here a few posts back with all the legal jargon.
    Please could someone answer this: am i right in thinking that delays caused by a knock-on effect from an earlier flight cannot be deemed as an extraordinary circumstance on your own flight, as the problem has to be with the plane you are actually on?
    The reason i ask this is when we flew to Barcelona on 24th May 2012 we were 4 hrs late, so the people waiting for that plane were 4 hrs late getting back to Manchester. Guess what - the very next week on the same day our plane arrives 4hrs late - it came from Manchester! Totally stinks of schedule shuffling to me as a method of cost-cutting. Should i mention this in my next letter when requesting evidence of the safety shortcoming?
    Unfortunately, i do not have the letter given to me by Jet2 at the airport on the day of the delay stating what the problem was. If anyone has this from the Barcelona / Manchester flights on 24 / 31 May 2012 please let me know. I feel this may contradict the explanation they are now giving me.
  • Hi, after some advice please. Jet2.com are refusing to compensate me for extra costs I incurred due to a late departure of there flight from manchester to split, croatia. Flight was delayed by one hour and then we set off, mid flight they announced tech difficulties and turned the flight back and landed at leeds, we then got another plane. We should have landed at 7.30pm but landed just after midnight meaning I had to pay £25 for late car hire collection and £60 for late apartment arrival. 5 letters to jet2 and lots of reply letters saying we aim to respond in 38
    days, only one actual letter saying they apologise but will not be covering the incurred costs due to the techinical difficulties they faced and stated they are just a point to point airline. I have written back again but have since seen the newspaper articles re compensation, seen as this has been going on since sept 2012 and they have been so poor in getting back to me should I write asking for the 5 hours delayed over 1500 km £320 is this per person? The total flight cost for my husband, my 2 year old and myself was £450.
    Looking forward to some advice.........its more the principal of the very poor customer service now.....if you try and speak to jet2 customer services on there 90p per minute phone number they just say that customer services dont have phone lines and you must email or write and all letters take well over a month to get a response.

    They'll just write back saying Extraordinary Circumstances. Do you have legal expenses cover with an insurance policy or premium bank account?

  • Re my last post, I sent my first letter on 26th and received a reply on 30th Jan. They asked for full details including copies of boarding cards. I obliged and also sent a copy of the customer care report given at the time of the delay which gave the reason as an 'operational problem with the plane'. I wonder what will happen next?

    I also stated I had read a number of Jet2 replies on the internet and that exceptional circumstances did not cover our delay problem.

    Jet2 ticked 3 "unreasonable" boxes with me in that they requested the same information 3 times over then did not reply....

    Any defense provided by Jet2 yet? The 28 days expire on my case on the 9th February.....

    Question for the legal beagles:
    Issued small claims on 4/1/13, deemed served on 9/1/13, jet2 responded 11/01/13. They have 28 days to file a defense from the 9/1/13. So presumably if nothing shows up on MCOL tomorrow, 6/2/13 I can file for judgement by default on 7/2/13?

    Be wary that they can file a day late and it not show on the MCOL file for 2 days more than that.
    But if 3 days have passed and nothing is shown, then yes, proceed.
    They should also provide you with a copy of any defence.

    M2spark - well defence was due today, and really they should send me a copy as well under the rules. I've received nowt. If there is nothing updated on MCOL by close of business on 7th then in goes default judgement. I know they can appeal this but it won't look good in front of judge :)
