    I wouldn't hold your breath ...

What's the odds that you get a "It's an unpredictable technical failure and therefore an extraordinary circumstance. It just is. Really."?

You'll probably have to start legal proceedings, but I guess you already guessed that.
  • Thanks again Vauban,

If i do need to go to court do i have to lodge the papers in Flybe registered address ie Essex
  • I contacted Flybe by email about a delayed flight from Glasgow to Exeter on 16/6/07. I gave them the passenger names and addresses etc., the flight number, departure time and distance, they tell me they can't investigate my claim without a booking reference. Sadly I haven't kept the last 6 years emails! Anyone else had this response? Any idea how I find a booking reference from 6 years ago?

Be careful you are running out of time, the 6 years expires in less 2 months and if you don't start legal action before the anniversary, any rights you have are lost. As you have everything other than the booking reference, I would send the letter before action and get going.
  • Thanks centipede 100,just had the latest reply from flybe.,
We take advice from the CAA with regard extraordinary circumstances and as the fault occurred just prior to take off and was of an electrical nature(VHF COMMS FAILURE). Should you wish to pursue this contact the regulatory policy group civil aviation authority
  • After another two abysmal flights, at peak time on the packed 14.35 business route from Aberdeen to Manchester, I have set up this Facebook group to allow people to share their experiences of this poor airline and get advice on how to claim compensation. I will be handing details of this group to flybe customers as I fly weekly with them. They are never on time, ever. The facebook group is called 'flybeware' and can be found by searching the name 'flybeware' Feel free to join and pass this information onto friends and employers.

I might be a lone voice but would it be ok if this site were extended to cover Loganair? There probably won't be much but they act as operating carrier for Flybe flying from Glasgow/ Edinburgh hubs to Scottish airports. I live on Orkney and they are the only airline we have. I have raised 3 complaints with them since August last year. I have finally lost my rag and am in the Sheriff Court Friday 10th May suing them for compensation due to cancellation, reimbursement of ticket cost (any advice on 'comparable transport conditions' much appreciated) and unnecessary inconvenience.
  • In June 2008 I was flying from Alicante to the UK and the incoming flight to Alicante was hit by a bird strike. The aircraft needed repairs and the spare part had to be flown in from the UK. After repairs the flight finally took off 3 hours 55 minutes late.

Would I be able to claim or would the bird strike on the incoming flight be classed as 'Extraordinary Circumstances'?

Have had claim refused three times now , latest email suggests Flybe consider a Technical Fault immediately prior to take off is an exceptional circumstance , they say the case law supports a claim for technical problems 24 hours before the flight but not immediately before .Is this view correct?
