    Resolver are pretty much useless CEDR can take forever Download Vaubans guide on page 6 is a template NBA send that give them 14 days to pay or you will start legal proceeding through the small claims court.

    I am in the process of issuing a NBA letter to TUI for flight delay on TOM2571 from Heraklion to Manchester on 21/9/18.
    I am following the Vaubans guide which advises to address the email to The Chairman and to send to their Head Office. Can anyone help with these details.

    Have you received any correspondance from TUI? If so I would use that address.
    You could also send a copy to the same address but also add Legal Department to the topline.

    This was for a delayed flight Manchester to Majorca on July 28th 2018. I submitted the claim immediately on return (13th August) and have finally got the cheque. Straight forward technical delay on this - just takes a long time as TUI did not respond at all until I went to CEDR.


    It seems the email address they advise you to use on their website [EMAIL="aftertravel.flightdelay@tui.co.uk"]aftertravel.flightdelay@tui.co.uk[/EMAIL] does not work and just leads to delays until you find another method.
  • So. Quick update. Have submitted claim to CEDR. Tui have filed a defence saying the operational delay was fuel contamination then medical emergency then no slot in flight timetable (crew out of hour I think). The operational delay was already more than 3 hours before the medical emergency. You might have guessed that tui are relying on the medical emergency as an exceptional circumstance. I've responded with an argument that the medical emergency is irrelevant if there is already a delay in excess of 3 hours, especially as the courts have already decided that contaminated fuel is not an exceptional circumstance.

    So now I guess we wait for the adjudication.

  • Don't forget the 3 hour delay has to be when you arrive at your final destination not when you leave on you flight. What was the medical emergency?
  • I have a claim against TUIFLY based in Netherlands as they were the operating aircraft (sent over from Netherlands) for a charter flight I took from UK. They agreed to handle the claim but are citing the reasons for the delay as 'crowd problems' (there were a lot of flights on that day) which the airport say is not the case. Would that be a valid reason for a departure over two hours late embarking , time spent on the runway before departure, and an eventual touch down 3 hrs. 2 mins late? If you believe my claim is valid who do I dispute their decision with in Holland as they are not part of the CEDR scheme.
