    I think that you have 12 months from the 8 week point to submit your claim to CEDR, so you’ll have until May 2019.

    We had a similar experience to you, also on 4 March, flying from Grenoble to Gatwick. TOM4759 was delayed almost 4 hours. The captain stated that it was due to the knock on effects of the previous adverse weather. We submitted our claim to TUI and just over a month later received a response rejecting our claim, like you with a change of reason to Crew Flight Time Limitations. We have responsed asking for clarification on the reason and stating that regardless, neither reason is considered an extraordinary circumstance, and asking them to reconsider.

    We were due to travel out of Bristol on a 2 March to meet a cruise ship, due to the severe weather we could not get to the airport, flight was delayed by more than 5 hours we had checked in on line but Tui refused to let us cancel saying we were a no show, 2 different travel insurances one has paid out the other says not covered.
    Tui keep telling us to claim on insurance, which will not pay out , my point is we had checked in so should have been able to cancel without claiming on insurance as technically we had checked in.....

    Tui have been no help when we first called they asked why we were calling them ! The holiday shop staff could not get in due to the weather for 3 days so how did they expect us to get to the airport when police etc said not to travel?

    Do l have any hope of getting any monies back ?

    Aside from travel insurance, no. It's your responsibility to get to the airport.

  • No not trying to claim twice as 1 insurer has paid out on half but feel Tui should payout as flight was delayed by 5 hours and technically we had checked in!
