Yes. Samara v MBI [2014] EWHC 563, reported 4th March 2014. Link is here. http://www.bailii.org/ew/cases/EWHC/QB/2014/563.html
The facts of the case are somewhat extreme, though

Is that Phil, David or Warren?0 -
Hi, made a claim for a flight from Thomson, only to be rebuffed as it was over the 2yr period THEY set - EU states 5/6yrs - CAA still say its valid, there apparently was a court case with regards to this - anyone heard anything about the decision?0

The CAA have finally investigated my complaint against Thomson airlines re failure to pay compensation for a delayed flight in Sept 2012. (The aircraft was unable to land at Skiathos due to what we were informed was a problem with the landing gear), consequently I lost a day of my short holiday and Thomson failed to respond to my communications to them.
According to the CAA's interpretation technical faults come under 'extraordinary circumstances'. They quoted “extraordinary circumstances” exception of EC 261/2004.
Can you imagine driving a coach load of passengers with defective brakes on the vehicle -I am sure "sorry officer it's extraordinary circumstances" would just not wash!!0 -
