Hi, My Thomson flight was delayed by 5hrs 5mins. I'm trying to decide whether to claim compensation or ticket value and have two queries.
I've seen two values in the links for the compensation relevant to my flight: £488 and £500 - which is the correct value?
My flight ticket also included £75 for baggage. I also purchased a further £40 for extra baggage, would these be included in the refund for ticket price?

You are claiming for a delay in excess of 3 hours for which there are set values (€) dependant upon the distance of your journey. The level of compensation takes no account of your ticket or baggage payment so refer to the FAQ's on Page One and the law (261/2004) which advises the level of compensation payable to each fare paying passenger.0 -

Hi, I've read the FAQs. One said that over 5 hours I could claim for a refund or compensation, not both. I'm trying to work out which option is best is best for me. If I claim a refund would it include the extra cost for baggage. If I claim compensation, which is the correct price.
I can see this is a compensation thread, so I'll investigate the refund option elsewhere.

111KAB said "there are set values (€)" so one assumes the difference is due to varying exchange rates.0 -

No as I said the difference is due to the distance of your flight. In your case you are entitled to 600€ per person and whilst the exchange rate can make a difference the 'normal' situation is to apply a commercial exchange rate on the date of delay. Like David I have not seen any mention of a refund or compensation (whichever is the greater in your case you are suggesting) and indeed I would also appreciate you posting a link to this.0

I suspect that it's just badly expressed. I think the point is you can get a refund if you don't take the flight - which then means you aren't entitled to compensation for travelling on a delayed flight.

My cases is due in court on 9th May so I am looking at preparing my bundle. Do I remember someone offering to help /guidance with this at one point.
Thomson are defending on three grounds.
1. Deny "Denied Boarding"
2. Proof I was on the flight and proof that it was delayed.
3-13. The Montreal 2 year bit
Our flight was DP3339, Paphos to Exeter Int. Airport on 12th Sept.2007
It also had this number First Choice flight FCA7363 but I can find nothing on this number.There is only one flight to Exeter on this day.
The flight was definitely delayed as we were herded onto a bus together with others that had taken a full holiday package with First Choice, and taken back to one of the hotels they use in Paphos.
I have my booking form showing the flight times as
Paphos dept 14-30 Exeter arriv 17-30
but when looking on Flight Stats it only looks as if it was 19 minutes late?
This is what it says

They had obviously changed the times or there was a delayed plane at the last moment otherwise the other travellers with First Choice would have been told by their reps at their hotels of the change in times. They were all taken from various hotels to the airport for the 14-30 flight and we checked in our luggage as they also did. Only then were we told by the reps that the flight was delayed.
We were on the same flight (different number) with Thomson the previous year, same date but by one day and exactly the same thing had happened and had been sent back to the same hotel for hours.By the time I realised we were due to compensation it was too late to claim and we only got in by days with the second claim.
Will my booking form be sufficient regarding the times as I am sure they will produce the Flight Stats which appears to show a delay of only 19 minutes? Is there any other way of confirming when the times were changed or why the plane was late? I would hate to fall at the last hurdle.
I also phoned Thomson and asked if they intended to ask for a stay but they were adamant that they would not which makes me think they will rely on the stats. Any suggestion will be much appreciated.0
