In summary, frustrating that we have to wait on Dawson, and kind of wasted a day in court, but a few small victories nonetheless. Roll on May.
Thanks for the update. Seeing as it's just either 2 years or 6 years in question now, shame you couldn't have got the judge to Order as such, so that payout was a done and dusted (with interest) thing once Dawson is ruled on.0 -
Just about to start court proceedings against Thomson for 18 hr flight delay back in August 2010. I originally wrote to them in 2010 and was fobbed off with original judgement going to appeal and revisited the case with them in February 2013. They are claiming extraordinary circumstances as their defence. I received letter from Spanish air authority (AESA) in December 2013 stating the delay would not constitute extraordinary circumstances and that I am entitled to 400 euros per passenger. Can anyone confirm the following please:
1. Can I claim for the four passengers that I paid for on one claim form and should I be claiming for 1,600 euros or the equivalent in sterling? 2. If sterling - do I use today's conversion rate?
3. Can I claim for interest and if so what rate should I apply? 4. Are there any other costs that I could claim for? Many thanks0 -

1) Use form N1 and claim 1,600€ - convert on form.
2) Use conversion rate on date of delay.
3) Claim 8% interest - you may not get this though.
4) No other costs other than claim costs however if/when it goes to court you can seek other costs ~ suggest you wait to see if it goes that far.0 -

We were delayed 5/2/2012 for over 5 hours on a flight from Lanzarote to UK because of technical trouble. I sent in the claim to Thomson (all inclusive package holiday) on 9/2/2014 and had a reply stating no because of the two year UK rule. (only 4days out)
Is the next stage to apply to EEC or the regulator in the departure country, also I have no documentation or boarding passes as evidence.0 -

I was on a delayed flight 2 years ago from Cardiff to sharm el sheikh on a Thomson Airways flight. I sent the template later away as written on the MSE website. Yesterday I received a very long winded, letter full of legal mumbo-jumbo, it is very much a standard letter.
Please can someone look at the letter and is if I should pursue with the claim with the CAA (or another method) or not to waste my time???

If you want it doing for you, you need to speak to a no win no fee firm.
