Flight delay and cancellation compensation, Tui/Thomson ONLY

    First of all apologies if I have asked before about the above flight.
    The reason they gave for the delay.
    The outbound flight left on time from Exeter, it wasn't until airborne that a technical fault with the cabin pressure came to light, even though it had passed all the routine pre-flight checks. The aircraft was diverted to Gatwick causing a 5hr55min delay.
    Last April I put this into the hands of a NWNF company. Because I have not heard anything from them I decided to chase them. They are still waiting for a reply from the Cypriot authority, but they are doubtful that we have a case because it was a safety issue. Surely all technical delays are a safety issue.
    Any advice as to whether I should pursue this any further would be appreciated, or should I go to another NWNF. Not got the confidence to do it myself

    I can send you my written summing up argument (don't worry: most people don't have to do this!), which will give you a flavour, if you think that's useful. PM your email address if so.

    You should not accept any witness statement that has not been signed, and be careful to check any "signed" version that is brought to court for differences.

    If you have questions about the statements - or just want to ask the witnesses about points you have - you can ask that they be present, or inference drawn from their reluctance to do so. Some judges (like mine) take quite a hard line.

    Which was the NWNF company?

  • I'd expect them toask for a stay until May so you may not be doing much arguing your case.

    May is the Dawson case isn't it? The judge in case has struck out the 2 year rule so they wont be able to ask for a stay based on that

    Thomson will not be bringing their witnesses, see my post here for how I think you should deal with that fact:

    I would make sure you have a large number of questions for the witnesses written down and make sure the DJ knows you have all these (unanswerable) questions. The first questions of course to T's B should be 'Where are your witnesses?' and 'Why have you decided that they are not going to appear?'

    I used EU delay. they were successful in my claim against Thomas Crook, just not very happy this time. Their excuse still waiting to hear from the Cypriot authorities, that as been the excuse since about last August, also without the information from them they don't think I have a claim. With Thomas Crook I did all the work in getting the Greek authorities reply.

    Flight TOM 2588. Manchester to Tenerife South, June 14th. 2013.
    12 days after claim submitted an offer of full settlement was received and accepted. Valid reason 'Operational Issues'. Cheque now banked and cleared.
    I have read and absorbed every post on this thread and would like to thank everyone who has contributed to the knowledge that has enabled me submit this successful claim.
    Will add details to 'Success' thread.
  • I am starting this thread for those claiming flight delay or cancellation compensation from Thomson.

    Any posts regarding any other airline in this thread will be ignored (at least by me).

    Delayed 10hrs last Feb.Thomson said we do not pay compo flight delays it was a technical fault.
    Got cheque this week for £992
