I also have a claim against Thomson, but did post in the correct thread.

The people who are able to give expert advice are more likely to see questions like this if post in the right place. They are more likely to take the trouble to advise you if you take the trouble to search to see if your question has already been asked.

    Thanks for being so understanding

What's to understand? The forum is rapidly becoming unusable because people refuse to (a) use the information available because it's easier to ask and expect to be spoon fed and (b) observe a few 'house rules', such as posting on the existing threads, as a courtesy to others.

I'm one of many on here who try to assist.

...Pilot illness has been discussed a lot on this forum - just search for "illness" and "sickness" etc in the forum. It could be regarded as extraordinary, though you could equally claim it is inherent in running a business and that proper contingency plans should be put in place.

Persuading a judge (which is what you are likely to have to do to get any compensation) will likely depend on establishing when the pilot fell ill, where they fell ill, and how long you were delayed for.

Looks like the bit to read and consider

Chezzer - did the documents arrive by 4pm as per the "Unless order" by Judge?

I received mine at 15:45 by email, but I shall be ringing the court in the morning to see if they got theirs. Although I wasn't aware you could send them by email or I would have saved a fortune on postage.

To Goagoer, I am not sure any legal firm will take on a claim that expires in 5 weeks time. You only have 6 years from the date of the delay to start legal action, so March 2014 is your deadline and it is too much of a legal risk to investigate, prepare and launch an action within that time. If you want to go ahead, read the FAQ's at the start of this forum and issue proceedings, it appears you have already sent a Letter before Action. If you don't feel you can do it yourself, I am afraid you have probably left it too late.

Thank you Alan, I'm sure you're right and it is too late for me to claim.
I thought I had enough time when I first contacted Thomson last July but thanks to their delaying tactics they win again.
