Thanks for the reassurance. In earlier correspondence, they even said that the wind was blowing in an unfavourable direction for the test runs (thus contributing to the length of delay)!
Unfortunately they've never actually said what the original tech fault was (other than an EC).
Have received their Allocation Questionnaire today which says they're bringing 2 witnesses. I must say, they are now pushing the paperwork though v quickly...odd given that they've also requested for the case to be stayed until their appeal
Thomson have sent a letter to request that my case is stayed on the time element however after speaking to the court it is just a letter on file and has not been passed on to the court as they need to make a formal application to have the case stayed so it will be down to the judge on the day

What law are you referring to? If you plan to take this further, then book a few days off work and read this thread!

Help please, received defence today.- claim re 42 hr delay. Admitting averred for the flight (correct flight number quoted), as in my correspondence to them from March 2008.
Para 3 requiring proof party travelled?? I did not retain tickets/boarding passes etc from Jan 08! Will I still need proof?(now found cheque pmt)
Para 5 - EC and defendant will rely on Nelson and TUI C581/10 and C-629/10. Where can I find full case details please? - have googled but cannot find complete details
Para 7 -Claimant is put to strict proof of loss? Does this mean how historic rates calculated?

Basically confirms that a delay of 3 hours or more is the same as a cancellation.0 -
after using up the letter templates and requesting a full written report on the 3+ hr flight from teneriefe,Thomson are sticking to their guns and claiming it was exceptional circumstances but still have not provided the report on the delay and if I should wish I can complain to CAA?
does this mean I have no claim against them?0 -

Of course not but exactly what they want you to think. Sounds as though you don't fully understand the procedure (bull from the airline) and I presume you have read through this thread prior to posting therefore I recommend that you seriously consider using a no win no fee firm rather than walking away.0 -

You are correct it all went straight over my head the day the first very long garbled legal mumbo jumbo letter arrived from Thomson lol
I have indeed read all the threads etc and still cant seem to get my head round itbut thank you for the advice, I think I may just do that
