Well they have filed their defense. After the usual 2 year rule nonsense they are claiming not their fault due to trailing edge defects. Very vague. I will challenge hard but any views anyone?
I also intend to go to mediation prior to court. Anyone had experience of that?0 -

They point blankly refused mediation with me. Unfortunate for them as would have saved a bit of money as I was willing to settle for a percentage less in order to avoid devoting time preparing for the hearing. Their loss, as they have now been ordered to pay the full amount, plus interest, plus court costs and the cost of their barrister. Don't know how long they are going to take to grasp that their understanding of ec is not the same as everybody else's, including the majority of district judges. Perhaps if they devoted as much time, money and energy into trying to avoid delays and having contingency plans, they would not find themselves in this position0 -
Hi again, just after a bit of advice if possible. I've started proceedings against Thomson and received a Notice of Issue on the 4 September. They had until 30 September to respond (defence or admission) but I've heard nothing? I understand from the paperwork that this means I can ask the court to enter judgement. Does this mean they will be ordered to pay and I won't go to court? Or is this just another Thomson delay tactic? I'm all fired up and ready for court, so it's just confused me a bit?! Thanks0

I had the same thing happen and sent off the Request for Judgement form. Unfortunately Thomsons seem to get away with being late with everything,as was my case and they just sent the form back to me when their defense was filed. Phone Salford and see if they have anything, if not send off the form. They can only send it back again and perhaps the judge will not let them get away with being late this time. Some hope though!!0 -

Ok, so if you think they have not given full disclosure prior to court, slap em with a cpr 18, ( make sure you read the rules before asking questions).
Then youll see if theyre serious about defending or not0 -

Hi I sent an email to thomsons after families flight was delayed 4 half hours in 2010. I have received a reply today stating by national law I only had two years to make a claim therefore they were not responsible for any compensation payment. Is this correct? If yes how could anyone possibly claim right back to 2005?0
