    I think that is highly unlikely. Thomson might be pushing their luck with the legal cases but they aren't completely stupid.

    I won my case basically on the grounds that Thomson didn't put up a defence nor appeal the Decree granted to me.

    I now have to enforce the court order and have contacted Thomson Via recorded delivery giving them a pay by date, or else.

    The only correspondence I have had from them was the standard letter, (investigating your claim etc) which I received, via my travel agent, amazingly shortly after the summons was served on them, nothing since.

    Shocking the way they treat customers who have paid thousands of their hard earned cash on their holidays.
  • I am in the same position. 14 days expired yesterday, but no payment. I have emailed them today to say that I will issue a request for a writ of execution unless they pay by the end of the week.
  • Just be aware guys, that sending in the sheriff is a better course of action than the regular court baliffs. Have a look thru the thread for reasons why. But I think they need to owe you more than £600 for that to be an option.

    I appreciate that that is generally true but, frankly, they are going to pay up if any enforcement action is taken and I would rather avoid the cost and effort of having to get the certificate to transfer enforcement to the High Court.

    jimcbob are you sure that Thomson were properly served, which address did you use, it's pretty easy for them to have the judgment set aside if you sent correspondence to the wrong address.

    If they were correctly served your best option is to use a High Court Enforcement Officer, they can force entry to commercial premises and seize goods, something a baliff can not do. This pretty much guarantees you get your money, and also hits Thomson in the pocket.

    I think the cost of using them is also recoverable, but I'm not 100% sure.

    I sent my letters, which Thomson eventually responded to and the court served them the summons at the same address. The following as it is written.

    Thomson Airways
    Wigmore House
    Wigmore Lane
    Luton
    LU2 9TN

    I'm assuming that if I got a response from them at this address then the summons would have been served successfully.

    They have definitely been properly served: they acknowledged service, lodged a defence and submitted an allocation questionnaire.

    Well if you're both feeling generous you could give them a ring and ask for your money, if however you feel that Thomson have messed you around you could turn matters over to a High Court Enforcement Officer
