An interesting article, and would hopefully serves to strengthen your claim.
Interesting to read the full range of Daily Mail readers outrage and indigation in the comments section though. Obviously members of the put up or shut up mob, "you can't expect a company to do what they're required by law to do, it'll cost too much", "it's EU medalling gone too far" or "why do some people insist on suing someone when something doesn't go their way, we're becoming like the America".......:(
I can understand some of these types of comments because I would have probably thought the same some time ago. However, if companies like Thomson had the decency to acknowledge the EU regulation and not try using poor excuses/lies like the Supreme Court 2 year limit etc, and just sent out some goodwill vouchers I probably wouldn't have pushed it so far. Its now a matter of principle for me. As for Thomson appealing the Dawson case on the basis of losing their 2 year argument, and then continuing to pay some people out who they originally quoted the 2 year limit at, i'm lost for words.0 -

If they had offered something as a goodwill gesture as we finally disembarked the flight (vouchers for 15% off the your next Thomson holiday), and not charged for drinks/refreshments on the delayed flight, my opinion of them would have significantly higher than it is.

I have received a reply from the county court informing me that my claim has been struck out as it appears to be time barred under article 35 of Montreal Convention - any suggestions as to best way to proceed?
Further to this, I asked the court to remove the strike from the claim (stating More) and they obliged with a hearing date set for October to consider the two year rule.
Just this morning received a letter from Thomson asking the court to stay my claim until the case between James Dawson vs Thomson Airlines in the Cambridge County Court (currently decided in favour of James Dawson) but on appeal is dealt with.
Classic delaying tactics here and starting to irritate me. Hoping the Court see it that way and reject Thomson's request.0 -

Possibly save some people time in waiting for a response to send in the form. I'm about to start our claim over a nightmare return from Palma flight TOM3251, delayed 22 hours!

Just wondering if anyone has faced an "engine ignite & circuit breaker issues" just before take off excuse from Thomson Airways yet? Or, if anyone knows anything about the validity of this excuse?

"The defendant believes, should the EC defence fail, the the claim should be stayed until such time that the court of appeal gives judgment in this matter"
Is there anything I can do to stop this? Basically if they lose they want to postpone this until this appeal is heard is that correct. Help and advice greatly needed.

Thanks mse I saw your email re flight delay compensation. And 3/4 weeks later we are £2171 better off after the excellent BA paid not just £1671 for 5, also have provided a £500 voucher too; delayed 4.5 hrs from Tenerife in June; :rotfl:0

They are taking a consistent approach then - sounds like common practice now then given my experience above.
Initially up to the court to decide if they will stay the case.
Waiting to hear what they plan to do with my case0 -
