    Hi. I too have received the 2 year letter. I have written and posted my NBA letter with regard to my two claims, one from 2010 and 2011. I thought out of interest I'd ring up and question the 2 year stance and why it was blatantly wrong. The lady said that they were well aware of the 6 year rule but according to guidance from the Supreme Court the claim had to be made within 2 years?

    I will still write but wanted others thoughts or interpretations of this.

    You are applying for payment of a statutory, fixed monetary amount of compensation. You are not making a 'claim' for a variable amount.

    I have also received the 2 year letter from TUI. Have sent back a response saying I am claiming compensation and have the usual 6 years to do so.

    I've said if they don't reply, I'll issue a claim at Northampton CCMCC.

    Time will tell.

    I too have received the 2 year letter and am in the process of contacting CAA. Is anyone else attempting to claim for flight TOM105 Punta Cana to Manchester 31/12/10?
  • Had our claim rejected by Thomsons today who stated that they are relying on national law which states you cannot claim if more than two years ago. Flight was delayed in 2008.

    Actual wording is:

    "The ECJ has confirmed that as the regulation doesn't say how long passengers have to bring claims we need to look at national law. The supreme court in the UK has said all claims to do with international carriage by air need to be brought within 2 years."

    Does anyone know if this is true or if this is a stalling tactic?

    Is it the CAA now?

    Any guidance would be greatly appreciated.
  • Myself and my Wife have today received the letter stating that the time limit for claims is two years. I have been lurking here and thank you for your kind advice.

    My Wife has done some digging and it seems the letter came from TUI Customer Legal Department. The head of the department is called Pete Baxter and their number is 0844 871 8143. My wife has called and found them more helpful than the usual After Travel department whose number was at the bottom of the letter we got today.

    I have also sent my letter to the CAA as advised above and have now sent a LBA.

    Hi, thanks for your post. I'm also in the same situation. I wrote my claim letter dated 07 Nov 2012, regarding our 22hour delay to Cancun on 11 Nov 2010. I completed the forms they sent and forwarded all required correspondence but I have now received a 2Yr claim rejection letter. Considering it was, by the skin of our teeth, not quite 2 years, how should I now respond? I notice you've sent an LBA letter. What does that mean? Any help would be greatly appreciated. Thanks

  • Today I received a reply to my claim regarding a delayed flight in June 2007. It stated in short "The Supreme Court in the UK has said that all claims to do with international carriage by air need to be brought within two years". Is this correct or are they trying to put me off claiming

    To all those posters who have received letters from Thomson regarding this spurious 2 year time limit, please consult the FAQs where the issue is highlighted and the reference to the ECJ judgment in the case of Cuadrench More v KLM.
