sorry, just me two bobs worth, time it right and ask for the manifest as part of discovery, no need for SAR,
Just about to post my SAR to Thomson but am now in two minds - not sure what you mean by 'as part of discovery', at what point would this happen? Thought I would need to include the proof in the court bundle once I have a date? Thanks!0 -

I would be grateful of any advice regarding pursuing a claim to Thomson, not sure where to start, or whether to bother or not.We had a 23 hour delay, spent the majority of two days at Cancun airport very stressful and spent a fortune on food and drinks.Am not a whiner or a moaner, but it ruined a fantastic holiday.0

Hi All
I had decided to use one of the Claims Companies to pursue my Thomson claim after Thomson claimed 'EC' to my flight TOM613 Cape Verde to Gatwick 22nd Nov 2012 being delayed 24 hour 41 minutes due to a technical fault on take off, a reverse thruster indication causing the Captain to abort the take off and await an engineer to be flown out from the UK to lock out the reverse thrusters.
I was under the impression from reading through the whole of this thread that tech faults were not covered by 'EC's', have I got this wrong?? As the Claim Company have replied with the following:-
"We have investigated your claim and must conclude that the flight was not conducted as scheduled due to an extraordinary circumstance.
Due to a technical defect the airline was not able to conduct your flight as scheduled.
In the scope of the EC Regulation 261/2004 you therefore do not have a right to financial compensation.
Or are the Claims Company just 'cherry picking' the easy claims??
Your advise would be welcome, do I have a claim or do I just give in??

You have a claim, for sure.
Even if these are deemed 'extraordinary circumstances', it's going to be difficult for them to prove the 'reasonable measures short of intolerable sacrifices' limb of Wallentin for a delay of over 24 hours. They need to get a planeful of people moving much more quickly than that, even from Cape Verde.
The claims companies are definitely cherry picking now that Saint Martin of Lewis has given them enough work for the next 5 years...0
