I wonder whether Thomson would risk losing a case for only €400 in Court by the fact that we have in some cases failed to include more than one claimant by using MCOL.
I have been trawling through for the answer to this issue as I too did MCOL and stand to either pay to amend my claim or see my claim cut by 3/4 and then have to start all over again for the other 3 passengers.
I used the N1CPC form which does not seem to fit for multiple claimants, as box 1 seems to be a name and address box as the next box asks for the address 'if different'.
If I follow the instructions as per the link in post #2104 and #2106 I can retype the whole thing, or cross out my name in the top box and in red type all 4 passengers as 'claimant', then lodge this with the Court?
Or should i retype it all into the N1 manual form that does have the magic (s) in the claimant(s) box
Do I need to fill in the N244 as it doesn't seem to reaslly fit this situation and the boxes are not easy to understand.I didn't do it, nobody saw me do it, you can't prove a thing!

A cynical mind might suspect that they simply don't want the hassle of a claim against Thomson, because they know they will have to work for their commission

I recently submitted my claim on the 16th July with Bott and Co through EU Claim and they have taken on my case by the 17th July they had sent their first letter and yesterday I received a letter from TUI dated 17th July (probably back dated) saying they are now investigating my claim and this is after I received a letter from them on the 4th July saying it was their final position in the matter I had no claim because of their 2 year rule - I would speak to Bott and Co again0 -
Could anyone tell me if they have had any success using Bott and Co and if so how long did the process take. Many thanks0

I was hoping the letter would be an offer of settlement, so this has ticked me off enough to explore the realms of discovery. I'll let you know what Im planning, but this BS with denying claims with little or no details of defence is usual tactics.
Also, the DQ is not signed, it has printed in Thomson Airways, hmmm investigations begin tonight.0 -

Reference #1430 we received a letter from Thomson dated 11 July. Apart from the very patronising tone adopted by the 'Flight Claim Advisor' it was 3 pages of inaccuracies as to the cause of the delay and irrelevancies regarding other cases. We have replied using very useful information from the Flightmole website re the proper definition of extraordinary circumstances & have given them a month to cough up. We know that we will be going to court then!0

Have you seen the CAA guidelines could be bad news for those of us who have already submitted claims.
The list of extraordinary circumstances where airlines may not have to pay lump-sum compensation includes:
· removal of unaccompanied baggage due to a serious security concern
· bad weather that impacts on the safe operation of the flight
· bad weather that closes the airport of departure or arrival, or where the number of flights are limited by bad weather
· air traffic control restrictions
· where a passenger or crew member becomes seriously ill or dies on-board or during the flight
· where a bird hits the plane
· where a hidden manufacturing defect is discovered
· where the plane is damaged by a third party on the ground
· damage to the plane caused by a foreign object which happens during the previous flight
· any technical problems which cause a turnaround or diversion
· premature failure of technical parts with a defined lifespan
· failure of technical parts where it is impossible to predict the failure in advance
· technical problems discovered shortly before the flight where maintenance has been carried out properly
· smoke, fire or fumes on board (not caused by a failure to maintain the aircraft properly)
· employment strikes, for example air traffic control strikes
· air traffic restrictions at the airport of arrival or departure, or where there are restrictions on blocks of airspace that the plane was due to fly through
· war
· terrorism
· closure of the airport for security reasons
· hijacking of the aircraft

Hi we flew with virgin to orlando and on the return flight we were delayed 27 hours. We put in the claim and yesterday recieved a letter from virgin saying the have declined our claim because of extraordinary circumstances. Our scheduled flight had a technical problem being a oil leak from the engine so that had to be changed and there other plane was under repair due to a lightning strike and couldn't be used.I don't think I will give up here as it seems they have fobbed us off with a answer that covers them and would stop us pursuing. Please anyone with any advice I would really apreciate it0
