  • You were lucky, after slaving away getting my papers ready, getting prepared to go to court, driving there etc, being sent away over the lunch break and spending 3 hours waiting to go in - after 15 mins the judge stayed.

    Plus you were saying some of the defendants statements were missing - I received the ones from TC at 6pm by email the night before my hearing :mad:

    Well I guess after reading this I am lucky! I did always suspect that if I did make it to the first hearing TC would ask for a stay anyway. Never mind. All I can hope for is jet2 have their appeal denied which might prompt TC to just pay out rather then the hassle of court..... Ones hoping :) good luck to you purple ice cream

    I apologise if this has (probably) been answered many times before but would appreciate some help. I've looked through the excellent guide on the site and many posts on this forum and can't find a definitive answer. My question relates to exchange rates, specifically:


    * Would the compensation claim be based on the current exchange rate, or the exchange rate at the time of the delay?


    * If it is based on the rate at the time of the delay, would this be the day the flight was scheduled to depart, or the day it actually departed/arrived?


    * Either way, where do I get the appropriate exchange rate. Is it sufficient to look at xe.com and get the rate from there, or is there a specific source for official exchange rates for this sort of thing?

    The date the delay occurred. Loads of sites do historic exchange rates - just google.
  • Thanks Vauban. Do you know if it states this anywhere in the Regulations? I've read them but didn't see this stated anywhere and would like to reference it in my reply to TC if possible.
  • Hi,new to forum,I emailed Thomas Cook on 12th.Sept.about claiming compensation for a flight in May 2010,trouble is I can't remember exactly what date,we were there in Ibiza on the 17th.May and only there for a week.I explained to them we boarded plane on time and sat for four hours before we were taken off the plane to sit in Newcastle airport for about another 6or 7 hours,today they replied to ask for plane tickets,boarding cards or tour operator documents before they could go ahead with claim,I phoned the number to explain I didn't have documents after 4 years,and they just said there was nothing they could do,where do I stand now,Thanks .

    Start off by finding out date. Flightstats is a good starting point.

    Do you have approximate date for your Newcastle to Ibiza flight (someone may have the time to check for you) - presume you flew on a TC flight and you registered on Flightstats.

    My case was stayed in court in June. I got the same letter this week too with regards to Weightmans, I just assumed it was their choice.
