    Errr... as he has already had a deniial letter after a claim form it's now time for court action via MCOL or NWNF.

    Briefly,won first time in court but judge would not rule on my wifes delay because i had not made her a co claimant at the top of the form, even though the tickets were bought in the same transaction and she was named on the claim and all evidence was the same for both of us !
    Further claim in the wifes name now at the court stage,the judge has scheduled a preliminary hearing.
    As the evidence was so compelling in the original case i am hoping the prelim is along the lines of lets save the courts time because, if it was nailed on for one it must be for the second heres hoping.
    My question is, i have dealt with the whole of this matter the wife only knows the basics and will struggle with presenting a case which she has done no research on,i have phoned the court and asked if i will be allowed to speak on her behalf and the reply was,"its completely at the judges discretion". Anybody any experience one way or the other ?

    My Judge obviously used his (sensible) discretion and ruled in our joint favour. Unless you really want the interest I would suggest you drop Monarch an email (it may or may not work) just setting out a reasonable time scale (14 days?) when you will accept payment for your wife + court costs so as to avoid another CCJ against them. At least will then show your next Judge that you tried. Should you need said email address please contact me.

    I don't think you've any right to speak on your wife's behalf, but you can ask the court if you can accompany her (I think this is called a McKenzie friend - google it).

    But like you I think it is positive that the court is holding a preliminary hearing. I wouldn't be at all surprised if the defence was struck out, and without much by way of cross examination. Indeed, Monarch may not even show up. Is the same judge dealing with your wife's case? Excellent if so ...

    Many thanks for the responses,particularly Centipede for taking the trouble to locate and post re Mckenzie friends greatly appreciated.

    111kab. had already written to Monarch without a response,anyway tried the e.mail option this morning but its still looking as if the mrs and i will both have to take a day off work, which is a real pain,not to say a complete waste of the courts time ! Monarch are a complete and utter shambles and their antics make no sense.

    I know of a hearing where the wife handed the judge a letter which read that she couldn't speak due to a sore throat and would it be ok for her husband to speak for her, - which the judge agreed to.

    Many thanks, I can picture the scene,judge looks at husband, husband looks at judge and a telepathic signal jumps between the pair of them. we are not going to look a gift horse in the mouth are we?

    Pleased to announce regarding my second case with Monarch at the very last possible moment re a flight they had already lost by a country mile previously, settled out of court. Monarch as ever dragged it out to the absolute end they have absolutely no shame.Having obtained two positive results,my advice to anyone thinking of going to court is. Have no fear their legal team is about as efficient as their airline in general and their management less so, in my opinion
    I will be back with the details later. Thanks to all who helped.
