    hi i was just wondering if anyone here was on a monarch flight roughly 5 1/2 years ago that was delayed by 9 hours + it was in august / september from newcastle . i am trying to find some information regarding flight numbers to lodge a claim, sorry for not giving the actual date but i realy can not remember only that we were delayed for hours and were given food and drink vouchers every couple of hours

    Had my court hearing this morning. Some of you may not be surprised to hear that Monarch did not show up. So the judge ruled in their absence. Took all of 10 mins. I Didnt have to say much, or claim their defence of EE was not correct, because the judge just ruled that as they were not there to provide any evidence of EE, my claim was justified.

    However, a point to note: I claimed for two passengers, myself and my partner (I booked). The judge dismissed this and told me that as per the denied boarding regs I could only claim for myself. I wasn't in a position to dispute this really, so I agreed.

    So....Monarch now have a month to pay me, I wonder if I'll see any money....what if I don't?

    We have had an offer from Thomsons yesterday and accepted but our claim was a joint one with my wife as 1st Claimant (she made the booking) and me as 2nd Claimant. We phoned the court and were told to do it that way.

    Well done and a good result.

    I'm supprised about only paying for you though, is that normal as both of you suffered and as you stated, you paid?

    Is there any link between Monarch not turning up and the location of where the court cases are?

    Also if anybody could recommend a claim firm I would be interested please. I appreciate this may be marketing so will only welcome genuine comments to my PM box please.

    Other than that I do have Legal cover on my house insurance but don't know how 'genned up' they would be.

    Would especially like to hear from some of the 'TOP DOGS' on here, you know who you are and have PM with great help in the past :T

    Interesting as in my case the Judge gave Monarch 14 days to pay up but the Barrister asked for a longer period. The Judge said he would accept 21 days but no longer as current jurisdiction did not allow him to do so unless there were VERY good reasons. So I have 19 days left to wait :)

    Congrats Pav, I hope you didn't waste time reading my witness statement then ;)
    Judge in my case provisionally accepted a dual claim, although my daughter was under 16 at the time of delay and claim.
    So you'll have to submit claim on MCOL again for your OH?
    What a waste of court time and resources.

    I'm happy to just accept compo for one passenger to be honest - as it was 600 Euros (plus court fees, travel expenses) it's a significant amount even though it's only half my claim. I just can't be bothered to go through the whole process again. I have achieved victory (well, from a legal perspective, who's to know whether I'll actually get any money!)

    She quoted the denied boarding regs to me - I didn't know them thoroughly enough to 'argue' otherwise (as I had put all my effort into understanding Wallentin-Hermann) - so I just went with it.

    Plus she was a bit scary, so just wanted to get it over with!


    I feel slightly frustrated by the fact that the ruling was pretty much based on the fact they were not there to defend - it makes me curious to know whether, had they been there, how things may have panned out. So it's not really a true test of the Wallentin-Hermann case, which is disappointing.

    Pavr27 - I bet any NWNF firm would take on your 'other half' as it is a 'no brainer' - if you cannot be bothered why not get another 400€ at c. 70% of 600€?

    Well done, I am just waiting on word from the court.....I was told to submit a claim form for every passanger, so you will now ofcourse be doing another claim?

    Well done Pavr27: we can all speculate about why Monarch didn't show. But it is hardly the action of a confident and organised airline, certain of their legal position. I agree with Centipede that you ought to be able to get the other 600 Euro now.
