pavr27 - if you want to PM me I'll happily share with you in confidence my own draft document, which tries to demolish a similar argument from Monarch (albeit regarding a cracked windscreen on a previous flight).

    Thanks

I was denied, went to Court and was awarded compensation - you should really read and post on the Monarch thread as advised by our learned friend Centipede :)

So, I get a response from Monarch today, 28 days was up this coming Monday. Turned down my flight as our arrival wasn't delayed by over 3 hours.

Hang on a minute, I think, scheduled 13:55, actual arrival 19:00. Start digging out all my paperwork then note the claim handler has put 10 May 2012 as our flight date...we flew 10 May 2013, as per my letter, and claim forms, and copy booking, etc etc etc.

Needless to say, immediate reponse to them along the lines of get your act in gear and check the correct dates, oh and don't make me wait another 3 weeks just because you don't know one year from the next.

Probably just the Monarch way of wasting your time. Don't assume it was a genuine mistake - they will put all types of obstacles in your way to try and put you off.

Oh I won't let it put me off...I will be calling them tomorrow if I don't get a response, no way I am waiting over 3 weeks for them to recheck it.

Well done on your success by the way 111KAB!!

In feb started the claim process for both the outgoing and return flights of our 2008 holiday.
Eventually they paid compensation for the outgoing flight. But had no mention of the return.
I replied to the email that was sent to us asking the return flights were at in the process. Quoted all the flight numbers, their reference numbers etc. Eventually after 4 weeks they emailed me to ask me again to confirm the dates. Of course these emails just go to a generic email address and the responses form a queue. So, I sent them a letter stating that if they did not respond within 14 days, I would refer to the CAA.
Today we received a letter in the post asking us to complete the claim forms.... Delay tactics to the max!
I am tempted to return the forms and add a letter in saying that they have 14 days otherwise I will go the small claims court.
Has anyone else had this problem when claiming for more than one flight. If so, what did they do?

I would send the Notice Before Action to the Company Secretary, and enclose a note with the claim forms advising that you have done so.
  • Lily,
What were the details of your flight that you were paid out on?
They can get added to the OP to let others know.
