Hi I have had my monarch 26hr flight delay rejected (engine fault) as extrodinary circumstances. I am ready to take them to court. sorry for ignorance but what is MCOL process that is keep seeing referred to in these threads. I can not see anything on Martin Site as to how to take them to court so any one who can help with the contents of a suitable letter template for my next step would be appreciated. Thank you in advance and anyone else need help along the way I am happy to support.0

Has anyone else had any success in getting 100% compensation for a delay of between 3 and 4 hours rather than the 50% original offered by Monarch. Also on this specific subject has somebody lodge a Small Claims Court proceedure and got a date for the hearing. From another Forum (50% reduction in delays for the flights between 3 and 4 hours) it seems that the CAA have indicated than in their view 100% compensation should be paid in line with their website for delays of this length, but it seems this carries no clout when it comes to Court. So what value is what is written on ther web site about compensation.!!0

Re above I am referring to post 1880 where the claimant got Monarch to up the compensation from 50% to 100%0

Pez4 took them to court, and Monarch paid up rather than submit a defence. What a surprise! If you want your money, you know what you need to do ...0 -

No value whatsoever as the CAA are no use. Your only 'friend' in the majority of cases is your local Court and indeed they are the only people you can, effectively, go to unless you want to leave the claim with a no win no fee firm.0 -
I wrote to Monarch regarding my 7 hrs 20 mins delay from Almeria on 31 Oct 2010.
Got no response and found their claim forms and submitted them with passport details, etc. Got no response.
Sent NBA letter on 7th May and gave them 14 days to respond. No response. Rang them on 21st May spoke to their EU claims department, who immediately e-mailed me their response. Standard letter, cut and paste. Quote "EC".
Our records show that the aircraft that was scheduled to operate your flight experienced a failure of the passenger address system which rendered the aircraft unserviceable and unsafe to operate. Engineers attended the aircraft and traced the fault to the PA amplifier. We made arrangements for a replacement part and engineers to be shipped down to Almeria from the UK in order for the rectification work to be carried out.
On the same day I had started MCOL proceedings. This shows the notice was served on Monarch on 22nd May and checking on line I see there is a note from Monarch legal team on 24th May to say they intend to defend this case fully.
I take it Monarch still have to file a full defense within 14 days and not just merely state they will defend the case.0 -

Unusual for Monarch as they seem to have been playing the 'game' all along. They normally wait the 14 days to say they are going to defend then use up the full next 14 days before they submit their technical problem=extraordinary circumstance defence.0 -
Got response from the court.... cant believe it....clearly stated on all forms, local court due ot husbands health issues and lack of mobility....
So where do Northampton allocate it!!!!!!!!
