    Hi All
Sorry to be a pain in the bottom but I have just had a response back by Monarch after sending them a letter about the NBA and they are still saying no.

    Now what should I do?
Does it cost much to do the N1 and court proceddings?

Love you all for so much detail and help you are giving to the rest of us. :)
  • hi all
can anyone possibly clarify something MON 3584 MAN - CFU
07/08/2009 this flight was originally delayed due to a technical flight with a delay causing it to arrive 12hr late. apparantly now (through another thread) monarch are saying the fault was fixed and aircraft deemed sevicible but the crew had then gone over their pemitted flying time SURLEY the onus is back on to the Monarch as it is then their fault. May i just add the flight wasdue to leave at 23.55 hrs and we were told approx 0030 hrs we would be delayed until 0900 following morning.

Yes that's right. If they don't have a crew available because repairs have delayed the plane and put the crew over their time then it is an operational issue (albeit caused by a technical one). Neither normal technical problems nor operational ones exempt the airline from paying compensation. But you will of course have to take them to court to prove this.

have sent my letter to airline yesterday so will look foward to the rejection leter lol then will take it further

    many thanks
  • Is anyone else pursuing ZB 516 Manchester to Barcelona or ZB 517 Barcelona to Manchester on the 3rd September 2012. I believe that the plane that was operating this run was delayed from Larnaca (ZB 648) and diverted to Birmingham. It would appear that that flight was compensated but not the Barcelona flights. I would appreciate any information about any of those flights.
    Many thanks
  • Finally received my delay compensation cheque today re flight ZB970 Birmingham to Malaga on 22/08/12.

Had a letter from Monarch dated 13th March stating the cheque would be forwarded within 14 working days, cheque is dated 18th March but envelope date stamped 11th April . It took Monarch 19 working days (excluding Easter), instead of the 14 stated, to send a cheque out. It looks like Monarch struggle to do anything on time :)

Thanks again for all of the advice on this forum - I will never use Monarch for flights again after the way they have treated people re flight delay claims.

How delayed were you? Does it take three hours to do a bomb scare drill? Security threats would be an extraordinary circumstance, in my opinion. A decision to do a drill would not.
  • Well, tonight I bit the bullet and filed my claim on MCOL.

    Particulars as follows :

"The claimant has sought compensation under EC
Regulation 261/2004 for delayed flight number
ZB238 on 20/09/2011 from London Gatwick to
Arrecife Lanzarote with a scheduled arrival
time of 1210. This flight arrived 8 hours and
39 minutes late. The passengers in the party
were the claimant and Xxxxx Xxxxx Xxxxx
    travelling under Monarch booking reference
XXXXXX. The scheduled flight length was 2,700
km therefore the claimant seeks EUR 400.00
per passenger. The total is EUR 800.00 and at
today’s Reuters exchange rate this converts
to GBP 683.63. Both passengers completed the
    defendant’s standard EU compensation form
and, having had no response to 14 days’
notice before action given by email and post
on 25/03/2013 the claimant now claims GBP
    683.63 plus costs."

Again, I'll update as I progress.

Thanks again to all contributors here.
