    In the absence of a CAA reply, and a virtually certain washing of hands from Monarch, then getting the case before a Judge - and a ruling on who is the airline to claim against - seems the ultimate course. Judge will either rule it is Thomson, and then your case will be found, or Monarch, in which case you will have a Court Order that they can't ignore.
    But this is going to take months, be clear on it.

    Oh gosh I dont know if I have the heart for all that. this has taken months already. is it really worth it all for whatever compensation i may end up getting. my flight was only delayed 3 hours & 8 minutes & Monarch state that if its under 4 hours they only give 50% anyway so i'll b lucky to get 400 Euros less the cost of my lodging the small claims court. :(

    You get your court fees back if you win. But it's your call. Maybe hand it over to a no-win no-fee, and get 70% of what you may be owed.

    I filled a claim one month ago for a family of 5 on a Monarch flight from 2008. I've just received an email telling me I am entitled to compensation!!!! (£515 each) I will post a follow up message when (and if) the cheque arrives.

    Thank you so much MSE - if I hadn't signed up to your weekly email I wouldn't have known anything about this.

    Flight details etc below - and good luck to all those still waiting to hear the outcome of their claims.

    Ican confirm that your claim for compensation has now been assessed and you areentitled to compensation in accordance with EU Regulation EC261/2004 due toyour delay.


    In line with the above a cheque to the value of£510 (the Sterling equivalent of €600 based on today’s Reuters exchange rate)will be forwarded to each claimant within twenty one working days.

    Congrats - excellent news for you. Even more excellent is that I understand that the sterling equivalent ought to be calculated as historical exchange rates - which will have been less good in 2008, I suspect.

    Do you know why you were delayed?

    Hi we were due to depart 20.10 arrive 12.30
    but did not depart till 23.30 ish and landed 4.50 but how do I prove it was a drill ?

    You have to write to the airline and challenge them on the point. They may fob you off, in which case you would have to start a court case to force them to divulge the circumstances of the delay honestly.

    I do wonder though whether an airline would deliberately make an airplane late in order to conduct a drill - esp such a late night flight. It doesn't sound very credible, INMO.

    Or was it a genuine scare that cabin staff were trying to play down to passengers. I can see some being unhappy to travel on being told there had been a genuine alert

    Certainly staff do tend to play down issues on the day so as not to overly concern nervous passengers (I wonder if this leads to some of the differences in reasons for delay). I had quite a discussion about this on another forum some years ago, but was told that it is seen as standard practice to not overly concern passengers.

    e.g. describing a safety issue as a tech issue

    I wrote to Monarch again giving them 14 days now for form filling but do I have to tell them I am doing that? Also how much is it to take them to court as money is tight.

    I don't understand what you mean by "14 days now for form filling" - what form?

    The costs of the small claims court depend on how much your claim is for. The thread "Taking the Airlines To Court" has some useful links.

    The scheduled flight from Cardiff to Orlando broke down in Cardiff (engine failure) so never arrived in America to take us home. We were told that Monarch had to fly a repair crew to Cardiff to fix the plane, then fly that plane to Orlando, rest the cabin crew for at least 8 hours, and then fly us home - hence the 3 days delay.

    This was no hardship for us as we had 3 extra days holiday in Florida, and now we've got (I hope) the extra bonus of a large sum of money. Double result!

    My sister and brother-in-law also travelled with us, so I've told them to submit a claim as well.

    PS: Slight typo in my original post its £510 each not £515, but as you say its still an excellent result.
