Should I have to pay to leave my contract?

    Well the phone was purchsed through buymobilephones.net, I know I must have received an agreement / contract at some point but I have no idea where it is :(

    What handset is it?

    Got to be honest and say that I haven't heard of 2 year warranties underwritten by networks, but that may be ignorance on my part. Have you got any paperwork to back this up as that may give details of what to do?

    Some manufacturers are helpful in sorting out repairs direct - HTC for one.
  • t-mobile offered supplementary phone insurance at the start of the contract, without this there will be no new phone. Unfortunately what happens to the handset during the contract is not their responsibility and if it breaks they may/may not be able to fix it.

    Despite what has been said, it sounds like your handset is no longer supported and there is nothing that can be done. The loaner phone being suggested is a £10 handset that makes calls/texts that's it.

    Best bet, buy a cheap PAYG and see out the contract. This is what I've done for the previous 4 month till my upgrade at the end of this month. However, with the farce that is EE i think i may change provider

    The phone is a HTC Evo 3D, I admit I was surprised when I spoke to T-mobile and they said it has a 2 year warranty. I don't have anything to back it up, just T-mobiles word so far. I guess I could ring them and ask for details of the warranty.

    If you didn't buy the phone from Tmobile why are trying to get them to repair it? They just provide you with the air time contract.

    Yeah I don't have insurance with them, but as the phone broke through normal use they said it was covered by warranty by either a repair or replacement. My handset was never sold by T-mobile that's why I had to get the phone through a third party originally and that's why it isn't on their drop down menu for returns although they admit this is a fault on their system. The shop loaner phone was going to be a smart phone but I had to pay a £60 refundable deposit which I was fine with. Yeah if there is no way to get out of the contract or get my phone repaired/replaced then I guess i will have to fork out for a PAYG.

    Basically because they said they would and they said it was covered by warranty. From what they say, if they could select the phone in their drop down list on the repairs screen then they would have no issue in sending it off for repair.

    Go direct to HTC or BuyMobilePhones, this has nothing to do with Tmobile they didn't supply the phone

    ok, I will try HTC, my only concern there is I haven't got any proof of purchase or anything but I guess T-mobile could supply me with that if I ask as they know who the phone was form and when I received it along with when the contract started etc.

    Almost all smart phones are covered under a 2 year manufacturers warranty, they may of been mistaken that they supplied the hardware or they might of been trying to do you a favor by sending the phone off for a warranty repair but it would of still of gone back to a HTC repair centre regardless of who sent it.

    No network would give you a warranty on hardware they didn't supply
