Well lets see what they say to my SECOND appeal........
Lots of bits in it thanks to people on here, but my lease grants me the right to park without any mention to a permit or a PPC or the landowning being able to change parking terms etc........0 -

Now that is one I would like to see the result of. Do you rent or own the property ?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Make sure you have a strong counter to their inevitable claim that "there are signs which means you enter into a contract and so are bound by it to pay the charge", even when you are parked ON YOUR OWN LAND.longtimelurkersam wrote: »Lots of bits in it thanks to people on here, but my lease grants me the right to park without any mention to a permit or a PPC or the landowning being able to change parking terms etc........0 -

I rent, but of course that doesnt matter as the rights conveyed to the property owner are passed to me as a renter.
I thnk we have a good argument for most of the issues they came up with for the last appeal, but we will see. I have a THIRD ticket waiting for the POPLA code to be provided as we speak so that appeal might have to be delayed a bit.......0 -

Yeh I told them I cannot read so it is was not possible to enter into a contract when I am unable to accept or understand the imposed terms that have been quoted.........mmmm actually that is quite an interesting defence ;-)
It will be interesting to see how they argue this one as the lease is a legal document that overrules anything else unless there are terms in it that allow elements, such as parking, to be modified at the freeholders desire.
It will no doubt be at LEAST 2 months for a response from POPLA on this one.0 -
Sam have you had a reply from popla with a proposed date yet.
I bet shona will find a way round your lease.
Ill eat my hat if she allows the appeal......For everthing else there's mastercard.
For clampers there's Barclaycard.0 -
Looks like things could get interesting, it would be nice to see a claim against popla for harrasment, or a breach of the Equlaities act, or both. From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
One thing i find funny is, if POPLA claim to be independant why do they tell you to pay up after rejecting your appeal?0

What I find amusing is 3 x appeals means 3 x POPLA fees. Could get somewhat expensive for the PPC.
I'd be tempted to use the vehicle like a 'honey trap'. With any luck you might cause the PPC financial grief.Never Knowingly Understood.

SOOOOOOOOOOOOOOOOOOOOO tempted to get a fake PCN just for this exact purpose! All I need is a disabled passenger. One day I will do it if no-one else does first.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
