What must be the main concern now is that the 60 or so % of victims who pay their PCN will still just as likely pay even after appealing to POPLA if this is the verdict they will receive.
We need publicity. Cannot MSE, together with members on here, fund a national advert in the media. I will chip in a fiver if everyone else does.0 -
At least it proved that it was a valid appeal despite hasbeen saying it was not a valid appeal.
So proves you can appeal on other items rather then those listed on the popla websiteFor everthing else there's mastercard.

If appeals to POPLA will almost always go against the appellant, and if that emboldens PPCs to head off to the courts, then the approach of go-to-POPLA-and-then-stick-two-finger-up-to-the-PPC will not be for the feint-hearted. Ignore is probably the best approach for a quiet life/line of least resistance to a 100% discount.0 -
From BASFORDLAD's original post it would seem that any appeal to POPLA is forwarded to the PPC for them to judge it and all POPLA do is agree with anything they say.
Could someone clear this up for me.
I believe that in the legislation that brought POPLA in ( and the BPA rules ) it states that any amount on the signs must be a genuine pre-estimate of loss, so how can POPLA say what the PPC is claiming doesn't need to be a pre-estimate because it's the amount shown on the sign ??0 -
One question that has been raised both on PePiPoo and on previous occasions is if the PPC asserts that the £100 sum is not a penalty, but a parking fee, where is the means to pay this money when you first park? Also there doesn't seem to be a time limit to that parking once you have paid. In other words, both parties have agreed to an open-ended contract, and you can park there in perpetuity. Quite a bargain!
Compare that to a "proper" long term car park, such as at an airport, where you pay so much a day, and pay that amount when you leave. Of course all this PPC "contractual parking fee" is a load of nonsense and is just an unfair penalty pretending to be something it isn't.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
That's where it falls apart in supermarkets etc . But for example cp plus in motorway service areas, they give payment options of paying by phone with a card, what happens if you don't have a phone or card ? They also don't have a time not to return, so you could leave for 1 minute then immediately return, so really it's pointless having such a term.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I think it is import to mention POPLA are a KANGAROO COURT owned and paid for by parking companies.
You know just in case someone is google'ing it thinking they are an official authority binding appeal service as opposed to a kangaroo court.Be happy...;)0 -

For the time being, yes, although I would be interested in seeing a rejection from POPLA raised as a complaint of misconduct. For example if the other OP on here (forget his name) really has been told by POPLA that he must pay up, then a complaint quoting the relevant section which states that the decision is NOT binding on the motorist.Je Suis Cecil.0
