Someone i know had a Atos Assessment and the Doctor contradicted himself a lot on the report....
The Atos doctor wrote that she Cried during the assessment and that she was nervous, timid and was very quiet when spoken to. The overall summary he wrote was that she was fine in the Interview.
They was other bits what didn't really make sense, When asked "Do you go out to the pub?" She said "No I haven't been for 5 years to a pub" The Atos doctor wrote She often goes out to socialize.
When asked "Do you go shopping?" She said "No my boyfriend does it for me as I have problems going out alone" The doctor wrote Goes out with boyfriend to do shopping. No problems shopping.
How can this be a fair assessment in anybody's eyes, Was it the doctor who simply misunderstood or did he make his own assumptions?
I will just add she failed the Atos Assessment and has just had her appeal, we was around 10 minutes in the appeal and she was awarded Esa, Let me also add that NO NEW EVIDENCE had been introduced at the appeal. The Judge came to the decision based on exactly the same evidence that the Atos doctor had to look at.
Now please tell me how that is a fair assessment?
A quick edit for anyone thinking I am having a go at the Atos doctor, I am not. I believe the computer puts in a stock answer at the end of a sentence in the reports...Eg.. The Atos doctor wrote that she Cried during the assessment and that she was nervous, timid and was very quiet when spoken to. The overall summary he wrote was that she was fine in the Interview. In that the Atos doctor reported the truth right up until the bolded bit, I think the doctor has wrote his observations (which remember was the truth) then the computer gave a stock answer that she was fine, hence 0 points for any of the social descriptors.
I don't believe the Atos doctor lies, I believe it's the computer's stock answers that are weighed to fail a person.0 -
Since 2010 from initial application I've spent 17 months on assessment rate, been awarded zero points twice, won 2 appeals and have never had to attend a tribunal.
In that time only my 2nd ATOS report (done by an elderly physiotherapist) makes any mention what so ever of any mental health issues and that was framed may indicate mild problems. But hey it's a start.
In that time 4 out of 5 decision makers who have looked at my claim have rubber stamped the original decision. The 5th was part of the team reducing appeals at the tribunal service so awarded WRAG after a 7 month wait. Last one was again a 7 month wait from appeal ending in call from the clerk of the tribunal service 4 hours before it was being heard telling me I didn't have to attend. This time 18 points and a minimum 2 year recommendation stating decision made based on the same facts available to the DWP at the time of the original decision. So no extra information!
That was september so if things run to form (and the DWP honor that recommendation) my next ESA50 will be hitting my door mat August, WCA face to face Jan, appeal lodged Feb you get the picture rinse and repeat ad infinitum.
The process and stress it causes me just knocks me out of reality from the moment the ESA50 arrives and continues for several months after the tribunal decision. During this time I am unable to participate in any meaningful way with any therapy whatsoever that can help me recover.
At least I had the help of a very good and dedicated welfare rights worker - they even had to arrange taxis for me to get to the tribunal as they knew I couldn't do it in the state I was in.
Thank goodness the cuts to legal aid mean that this help has now been withdrawn so next time will be fun! The only saving grace for me is that I have 2 sets of appeal submissions and and can copy out my forms from them so as long as the regs don't change I just might get through the process.0 -

Nice but meaningless [ly] pretty pictures of the sort a 6 year old would post to a friend. Nothing .. .. absolutely nothing to do with the subject, which was "relevant WRAG / non-WRAG mortality rates" your picture is irrelevant to the subject - but pretty.
Now look, if I've been hypnotised by your pretty picture and have missed which group in the picture are the WRAG group and what proportion of the UK population they form. Please tell me. Go on tell me where are the WRAG deaths in your graphic ?
Additionally, (1) if I can be of any assistance to on your understanding the difference between content and social comment when debating these figure I'll be happy to oblige, most rational people would not confuse the figures I gave .. .. with the social comment I made on the stress individuals undergo when completing a WCA. Now (2) it is clearly the case, last time I checked that being in the WRAG group is not of itself a primary cause of death, you might want to consider that fact before posting another pretty picture. Lastly (3) I'm not " trying to attribute those deaths to atos/wca/dwp decision" I'm giving facts and .. .. letting people think about those facts

1st feb l recieved the ESA50, deadline is 4th march. 2nd feb l recieved my appointment for the Atos assessment on 13th feb. Can I ask the Atos rep why as l understood the information was to be sent back before the medical & then it would be decided if l needed a face to face assessment.Clearly this has not happened.0

That's a tricky one :huh: don't expect an answer. I requested all my info between the dwp and Atos using a request for information form and on the esa it was stated by a Nurse that the information I supplied wasn't clear? how much more clear do they want than I'm slowly dying after my quadruple bypass. These people are simply killers.:mad:0 -

- the - national average is 6.5 deaths per 1000
- the - WRAG group average is 137 per 1000
It doesn't matter if any individual in either group is :
- fit or unfit
- sunbathing in eleven~a~riffe or at a family wedding
- asleep in front of the TV or lifting a heavy weight at the time of their demise
The only difference between the groups is the WRAG group has just been through the very scary mental process of torture and humiliation and been placed in the WRAG group.
What's very worrying is that these Atos numpties clearly haven't carried out a pre-board check or even read the clinical evidence submitted by the claimant. If they had then maybe these people wouldn't have had the extra stress and strain of being dragged into an unnecessary WCA then being found fit for work by these cowboys.
Maybe the WCA didn't kill them per se but the unnecessary worry of having to undergo one by this outfit because Atos didn't do their jobs properly certainly wouldn'y have helped their already fragile condition
And as for the poor old Atos supporter moonlighting as the Atos PR Rep to post a "What We Die Of" graphic smacks of a poor desperate soul frantically trying to justify the unjustifyable.
It was still hilarious though what the troll posted given what they were trying to prove.0 -

So Atos sent you a ESA50 on Feb 1st giving a deadline of March 4th then on Feb 2nd you get an appointement for a WCA on Feb 13th!!
So how can Atos order you to attend a WCA when they may not have even had the ESA50 returned to them from you!!!
We know Atos work to targets but this is ridiculous ordering someone to attend a WCA even before they've got to see what's been written on the ESA50 and if any accompanying medical evidence was included.
Have you telephoned Atos to explain how stupid they've been?0
