I have said several times. These HCP's earning some money on the side with ATOS should be quite easy to stop. It should, if everyone did the same, stop the assessments dead in their tracks. Just by following these guidelines:
Professional misconduct
If you think an NHS practitioner or social services employee has been guilty of professional misconduct, you can complain to their professional or regulatory body. Examples of professional misconduct include:- practitioners who have a sexual relationship with a patient,
- practitioners who claim that they're competent to practise but are not,
- practitioners who falsely claim that they're qualified to practise,
- breaching confidentiality, and
- manipulating patient's medical records[/B]
The last one is interesting. So many claim their report has no bearing on the actual medical. Even the witnesses agree. So, isn't that manipulating patient's medical records? Manipulating the record to read how both the DWP & ATOS allegedly wish them to be read.
Professional regulators
The purpose of the professional regulators is to protect and promote the safety of the public. They do this by setting standards of behaviour, education and ethics that health professionals must meet. They deal with concerns about professionals who are unfit to practise due to poor health, misconduct or poor performance. Regulators register health professionals who are fit to practise in the UK, and can remove a professional from the register and stop them from practising if it's in the interests of public safety.
Details of how to contact the professional regulators are available from the General Medical Council (also available in 12 other languages).
Healthcare regulators
The healthcare professional regulators in England are:
- Doctors: the General Medical Council,
- Nurses and midwives: the Nursing and Midwifery Council.
- Dentists, dental hygienists and dental therapists: the General Dental Council.
- Dispensing opticians and optometrists: the General Optical Council.
- Pharmacists: the General Pharmaceutical Council.
- Arts therapists, biomedical scientists, chiropodists and podiatrists, clinical scientists, dietitians, occupational therapists, operating department practitioners, orthoptists, paramedics, physiotherapists, practitioner psychologists, prosthetists and orthotists, radiographers, speech and language therapists and social workers in England: the Health and Care Professionals Council.
- Osteopaths: the General Osteopathic Council.
- Chiropractors: the General Chiropractic Council.
The Council for Healthcare Regulatory Excellence (CHRE) oversees the work of the health professions regulators. It carries out an annual performance review with each regulator, and looks at whether the regulator operates to agreed standards. CHRE looks at the final stage decisions made by the regulators on professionals' fitness to practise. If a decision is unduly lenient and therefore fails to protect the public, CHRE has the power to investigate it further. You can find out how to report a health professional on the CHRE website.
So, if everyone complained as well as lodged the appeal, these HCA's would have a choice. Tell the truth or see their real job put in jeopardy. If those who won on appeal complained, the system would lock up within weeks.

Richie, I am not talking about a complaint about the medical, process or what ends up as answers on the form to someone aimed at that process. I am talking about complaining to their day job regulator. Showing their day job regulator that they say one thing during the day whilst in the employ of the NHS another when taking ATOS's shilling.
If these people knew their day jobs would be under scrutiny, maybe many, many different "HCP'S" would think twice?0 -
I have been reading this thread with interest, as my mum is currently going through the Atos motions. So far I must say it has been exactly like the Atos Rep has said it would be....
I filled Esa50 form and sent it off on Dec 12th, and Yesterday we got confirmation from our doctor that he had received the form from Atos, think it's a 113 form and that he'd filled it in an sent it off....
So now we are awaiting the next step....A lot of evidence was supplied with the Esa50 form including two letters from our doctor one for her mental disabilities and one for her physical disabilities, He said if Atos read the letters and supporting evidence they should be no reason why she should be called in for a face to face assessment, also from what the Atos rep has said on this forum, if a person shows enough evidence then a face to face assessment should not be needed.
As for now we play the waiting game.0 -

I'm clearly saying if 100% of those that whine here complain, the stat posted just two days ago by the ATOS rep of only 2% registered complaints would rise off the graph. Who they complain to, or what they complain about is not important to me. What is important is they complain to an independent as well as a dependant venue.
Once a complaint, any complaint for example to ATOS, was written up the hard work is done, apart from a different covering letter they could send it to 4 different venues for two quid, the price of 4 stamps.
I myself believe that complaining to their own physio / nurse / doctor / regulating body is akin to complaining to their own worker protection union.Disclaimer : Everything I write on this forum is my opinion. Mordred from my experience when they get it right, it's been spot on. When they do get it wrong, they get it wrong in so many ways. The only advice I can give anyone going through it is, to cross each bridge as you come to it. They do get it right sometimes (2 out of 3 in my and dd's xp). Sometimes there is no need for a face to face if there's enough medical evidence. Sometimes there is. What the ATOS rep did not say and should have done is to point out that the claimant is under no legal duty or has any responsibility to send ANY evidence in!
The job of gathering evidence is fairly and squarely in the ball court of ATOS and the DWP and NOT the claimant.
When ATOS receive the completed ESA50 they should either make a decision based on that form or if they are undecided what to do, should issue an ESA113 to the GP for a medical factual report.
I have no idea where all of this 'requirement to send evidence comes from'. It wasn't that long ago that ATOS when sending out the ESA50 to complete stipulated that NO evidence should be sent to them with the ESA50! Have the regulations chaged? I don't think so.0 -

ATOS don't always get it wrong. I hope that your Mums claim is one of these.
But If they do you now have Info from this thread and others from this site and the many other sites that are out there, To move forward and get it sorted.
