Thanks so much for that. I've told her that she must give the intimate details about her toilet needs and what her hubby has to do, and she's OK with that, and she's read through the copy of the form.

But what does this mean - the problems she has relevant to the DLA criteria. Is there a web site that lists the criteria please? Many thanks. :)

    xx

I am sure that there are many reading this that are more informed than myself, but here is a quick guide which may be useful:

  • Anyone answer this?

If your appealing an ESA decision and still waiting for a date and its 6 month since you appealed, can you be sent for another assessment centred round your initial esa50 and without word from the DWP,by that i mean just an appointment turning up in your post from atos?

I'd like an answer to this, although I haven't appealed, my assesment was rejected by the DWP in October and returned to ATOS (original assesment was in August, following an aborted assesment in July as the assessor wasn't sufficiently qualified to asses a condition which I no longer suffer from). My condition has worsened since the August date and stopped responding to drugs.

I should be in the support group according to the descriptors, but since me contributions based ESa ended in January, I've been getting nothing.
Please forgive me if my comments seem abrupt or my questions have obvious answers, I have a mental health condition which affects my ability to see things as others might.

As long as you still meet the ESA requirements you can ask for a supersession and have you claim looked at again if you can provide medical evidence that you condition has deteriorated.

Do you know how long you were placed in the WRAG for?

I wasn't placed in anything at all, although I was only awarded 6 points, the decision makers have sent the report back to ATOS as they weren't satisfied with it, and it seems that is where it's stuck.

No it's definitely lies that atos tells... And I have the ESA85 to prove it.

My ESA85 also shows the HCP lied for pretty much all of the report.

I have no problems with them observing me in the waiting room, or anywhere else. But to say something like... the applicant makes no rocking movements which would be seen if she was suffering from depression/anxiety....... Hello! Not everyone who suffers from depression or anxiety rocks back and forth. The rocking movements seem to be another favourite of ATOS.

I wouldn't bother even replying to Fridge3, he cherry picks the posts he wants to troll and even then twists and manipulates what has been posted.

Like you I have no problems with being observed in the waiting room etc as long as Atos are honest about this (such as in the WCA Handbook).

With regards to the "rocking movements" I asked that question repeatedly on this thread such as at (http://forums.moneysavingexpert.com/showpost.php?p=58804081&postcount=371). Atos sort of replied at http://forums.moneysavingexpert.com/showpost.php?p=58995983&postcount=666 however their answer does not really explain why their protocols are different to the report produced by LiMA.

I know, he's not answered my previous posts about ATOS lies, but I'll keep picking him up on them cos it seems he has no answers :)

As for twisting and manipulating what people say, he should do well working with ATOS :rotfl:

OK. Since you were getting CB ESA you were probably in the WRAG otherwise if you were in the Support Group you'd still be getting paid.

So do you know how long you were placed into the WRAG of CB ESA for? Just because you are no longer getting paid doesn't mean you're no longer in the WRAG of CB ESA.

As I understand it, no decision has been made, so I'm not in any group.

If you were getting paid CB ESA which ended in January you must have been in some group probably the WRAG otherwise you wouldn't have been getting paid CB ESA.

What did you mean when you said "my assesment was rejected by the DWP in October and returned to ATOS"

You cannot get paid CB ESA without having had a favourable WCA decision form the DWP. So exactly what benefit were you getting paid which ended in January?
