UKPS Parking ticket

Hi i got a parking ticket on 21st Dec for not parking in a marked bay at Pallion Ind Est Sunderland, on the day i never noticed any signs as it was very busy, this is an appeal i sent in to them against the fine.

I wish to appeal againt the parking charge i have been given for parking out of a parked bay at pallion retail park sunderland. I had previously dropped off my sister and my mother who is 85 and has the use of a wheelchair and is also registered disabled with a parking card serial no RVMJYZ. I got a call to pick them back up a little later and as i got to the retail parks there were no disabled parking places to be found and very few spaces anywhere near to the shop my mother was in so as i was not staying long i found a space beside some other cars on the road with no markings. My mother also has the use of oxygen and due to the weather also i wanted to be as close to her to pick her up, i was no longer than 15 mins at the most its not often my mother gets out and when she does we usually always find a decent place to park but due to how busy this was it was my only option. I hope someone will look at my dilemma and show some compasion on this occasion.

Vehicles parking at the above location must be parked within a correctly marked bay; there are numerous signs at the car park which state that vehicles should only be parked where a marked bay is present and must not be parked on, over, out of the lines forming a marked bay or in a bay marked for a specific vehicle type i.e. Ambulance, Police, Coach etc. Parking out of marked bays can cause obstruction, inconvenience and safety hazards to other users of the car park. By parking the vehicle out of a marked bay the driver contractually agrees to pay a parking charge of £100 (reduced to £60 for early settlement if paid with 14 days from the day of issue), which remains unpaid. As the parking charge was correctly issued on this occasion it will stand.

Your representation has been rejected for the reasons supplied to you. If you wish us to consider any additional information which you believe supports your appeal please provide this within seven days. You may also appeal to an independent assessor through POPLA (Parking on Private Land Appeals) for tickets issued 1st October 2012 onwards details of which will be sent at the appropriate time.

    It is not a fine, it is an INVOICE.
    They can not fine you, they are not an authority, just someone pretending to be.
    Ignore them from now on as thousands have already, Get reading the threads, you will soon uncover the scam, yours is NO different, same boat as everyone, just a invoice backed up by vague cleverly written threats and free incorrect Legal advice .
    If ignored they will pretend to be other people such as debt collectors and solicitors, they may even send fake court summons papers which are not filled in and filed at a court, all part of the bunny boiler scam they run.
    The law says they can pursue you for actual losses only, which in a free car park is Nothing.
    Anything else is an illegal penalty.
    Read up, sit back and smug up, you have just saved yourself some money.

    Hang fire until Coupon-Mad comes on later, but I'm wondering if that response has contravened the Equality Act 2010.

    There MUST be a reasonable adjustment made by the landowner (and hence the PPC chimps acting on their behalf) to accommodate the OP's mother's disability needs, and despite being made aware of such a requirement they have chosen to ignore it and press ahead with a demand for payment.

    I would be looking to find the identity of the landowner and send them a Notice Before Action of an intention to sue under the Protection From Harassment Act 1997 and the Equality Act 2010.

    But see what Coupon Mad says when she sees this.

    Do NOT be paying the parking company any money!

  • As well as what the others have said. i.e. it's an unenforceable invoice, so DO NOT PAY, once Coupon Mad has added her two penn'orth, you should not bother trying to make a better case with UKPS, but go straight to POPLA (as it'll cost UKPS money, and you still won't have to pay, regardless of what they say).

    UKPS state you'll get a POPLA reference "at the appropriate time", so you'll need to respond to them saying that you are not making any further representations to them, and therefore you want a POPLA reference within 35 days of your original appeal, otherwise you will deem your appeal as having been accepted, as per the BPA Code of Practice.

    Most of all, and to repeat, DO NOT PAY.

    They are not allowed ticket a vehicle with a blue badge showing, they are breaking the bpa code of practice. And because they are not making a reasonable adjustment, they are breaching the equality act as well. I would write back in writing that they you intend to sue them for this breach unless they immediately drop this. Quote this below from the bpa code of practice.

    16.1 The Equality Act 2010 says that providers of services to the public must make ‘reasonable adjustments’ to remove barriers which may discriminate against disabled people.

    16.5 If your landowner provides a concession that allows parking for disabled people, if a vehicle displays a valid Blue Badge you must not issue it with parking charge notices.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I have deleted my two posts that refer to "UKPS". It appears that contrary to the thread title, the OP is actually talking about our old friend UKCPS. Sorry for that!

    It's not a fine and do not even think about paying it!

    Normally you don't have to do anything at all, but you have inadvertently identified everything about your fake PCN and we know this will spur UKCPS on to try to 'up the ante' with you now. You've given your name and the location and exact text of your appeal so Peter Haswell knows you are on here now. He trolls these forums we are fairly certain, has been known to send a pm to a newbie like you offering to help (but in your case he doesn't even need to do that as you've told him who you are).

    However, certainly do not pay as this is a fake PCN and it seems that UKCPS have breached the BPA Code of Practice and the Equality Act, as already posted quite rightly above!

    And do not panic, there are other ways to get this cancelled apart from appealing to a private firm whose agenda is money, not parking management. And no PPC seems to care or know about disability law at all - all they know is the Blue Badge scheme which doesn't even apply!

    I think you should complain to the Retail Park Management Company and copy in UKCPS (not worded as an appeal full of excuses, no 'sorry', no 'please' and no 'thankyou'!). Demand that the fake PCN is cancelled immediately and ask for an apology - let this be your 'other evidence' UKCPS have asked for! :D

    If you can't email them both then write a letter to both, again make sure you word it as a complaint, don't fall into the 'polite letter' trap because that won't work.

    It would have been obvious to the idiot issuing the fake PCN that there was a Blue Badge on show (irrelevant really but the only thing the scammers understand) so he should not have issued the ticket at all, it's a breach of the Equality Act 2010 and against the BPA code of Practice too.

    Even if here was no Blue Badge on show (as afterall you weren't in a disabled bay) this is harassment and breaches the Equality Act anyway.

    Also try complaining in person to the Customer Service desk at the Retail Park if there is one. Take your Mum with you and copies of all the correspondence and the fake ticket and COMPLAIN in person as well.

    Show them that your Mum is clearly a disabled person, she was shopping there and if UKCPS want to pretend they know about 'parking rules' they should know that, on street, a car can be lawfully parked to assist the boarding of a disabled person being collected - even on double yellows! As there were no lines or signs to the contrary at that spot how on earth is a driver supposed to know there is a risk of a fake ticket for a perfectly lawful collection of a disabled shopper?

    it's simply NOT GOOD ENOUGH that you are going to be running scared of debt collector letters through the first months of 2013, all because of the Retail Park using a (very) infamous PPC who have sent a template rejection letter because their modus operandi is only about money!

    That lady realised the bigger picture as soon as we advised her - and she wrote a VERY strong complaint email.

    She sent it to the PPC and to the Managment Company as hers was the same sort of scam situation as yours, in a Retail Park too and she got an initial template rejection by UKCPS as well. You could send a pm to caryl2506 for help and guidance about how she achieved her cancellation, she started out as a newbie like you too, only a few weeks ago.

    In that recent linked case, Glamorgan Vale Retail Park's management company got the fake PCN cancelled in two days flat! They really jumped to attention when they saw that the lady was very annoyed and that the situation was a breach of the Equality Act 2010 (use those words, because to harass you over this with letters IS a breach). And the parking company is the agent of the retail park so they are guilty of harassment & disability discrimination if they don't get this cancelled.

    Do you think the % of disabled bays there is enough? If not then say so in your complaint and ask when the provision was last reviewed because it seems the Retail Park are failing in their duty of care under disability law. Possibly there has been no regular review of the disabled bay provision - which is asking for trouble by the Retail Park - the law is not just about getting a protection racketeer to 'police' the bays, having slapped some signs up and run off some impersonations of parking tickets to fleece customers! And no car displaying a Blue Badge should be given a fake PCN anyway, it's in the BPA Code of Practice (point this out too as your extra evidence if the BB was displayed).

    BE VERY ASSERTIVE. Let us know how you get on and don't just rely on the personal complaint alone, go with the hardline written complaint because if you don't play hardball now then I suspect Haswell will try...and if this still isn't cancelled after your Letter Before Action complaint, then demand a POPLA code and see what they say!
