    It seems difficult for some people to understand that when one person is sick then he is sick. I really do not see anything relevant in the posts of the lasts saying that they have seen the posts in others forums and also this make them confused : what should make them confused it to notice that the advice in the different forums are really different.

    However, for all thanks for your 'contributions'....

    Ps : I hope that will make happy the people that are 'trying to help me' : I have not asked any amount against this dishonest landlord because I am just tired other unfair persons (these lasts use to state that the sky is green when it is blue).

    You can come in few days and put useless posts here but i will really do not have time for this (cannot waste energy and time especially when I am sick).

    During my sickness period JobCentre had refused my Employment Support Allowance due to the fact that I am an EEA citizen that has not work permanently during 5 years in UK : since I had not suffered all this harassment and hardship caused I would not certainly be totally sick for two months (I was previously managing my headache by staying active for work). Also, could I at least deduct this unpaid benefit from the rent or claim for it at the court. Because, this unpaid ESA is presently making me late for the current month (rent was up to date until 05 March 2013 and I am going to the court hearing in a week)?

    The way court hearings work in this country, you are supposed to make pleadings in advance. That way both sides know the other side's case before they get to court. You'd need to ask the judge's permission to alter your case so close to the hearing.

    Besides that, it's all supposition, etc. Why not stick to your big point, namely that the case should be dismissed as the LL did not register the deposit and give you the required paperwork on time? Job done, case dismissed.
    No reliance should be placed on the above! Absolutely none, do you hear?

    I had just a doubt (caused by solicitors I have met two weeks ago).
    I was also trying to prepare a 'second case' defense in case....because the landlord had not provided a rent statement with his claim. I have checked it again this week several times there was not rent arrears at the date of the eviction notice nor valid conditions by landlord for section 21 to be served.

    But I totally agree with you about what I have quoted above.

    'In this country' as you say, I have received the final decision of JobCentre six weeks after start being sick and two weeks after have return my defence claim to the court. However, in my defence claim, as previously stated, I have detailed the fact in the compensation part saying explicitly that I think I deserve something from the damage caused by the landlord but did not put any amount : I think i can provide this amount even at the hearing date.

    If you are not entitled to a benefit then that is it. You can not claim this unpaid benefit money from the court or your Landlord.

    You really need to sit and look at where you are going. You have 3 threads running at the moment.

    1, You want your Landlord to take your unpaid benefit off your rent.(Or the court to do it)
    2, You want to be paid for your voluntary work.
    3, And you want to be excused from work programs to do this 2 days a week voluntary work.
