Bank sent someone elses statement

    I too receive my 3rd lot of statements for the same account today (just like buses - took ages to get the first lot then another 2 came along at the same time!!!) and low and behold they didn't all belong to me!!! This makes me wonder where the rest of mine's are!

  • Hi folks, I got £800 back from FirstDirect no trouble - about 75% & was happy. My nephew has tried and his bank has sent him 5 years worth of someone elses statements - contrary to privacy, security & data protection act... Must be going to be very embarassing for them.....
    Unfortunately nephew didn't notice.... he added up all the charges, sent them back to the bank, they didn't notice the error, bank is defending it and their solicitor hasn't noticed the error either.....
    They did make an offer which was <10% of total claim (with interest...!) but he refused it, still not noticing error.
    Case was done on line at Northampton Court who evidently didn't see the error either and they have referred it back up here to home.... case backed up at present due to number of claims..... so no hurry.

    OK, whats the best action here.... We should contact the guy whose statements we have but there maybe many more - if the clerk who did this had say 10 sets on their desk when posting out..... We are going to make an appointment with the manager but should we go to the press, the ombudsman or what.... should we stop the case in the meantime...?

    Writing to the bank regarding the incorrect statements is the first move, possibly along with a little grassing up to the Information Commissioner!

    As far as the court claim and the erroneous claim amount, well I'm afraid the total responsibility for that is down to your nephew, he should check and double check anything that is submitted to the court. He will need to contact the court to put a hold on the claim whilst he gets the correct figures and either amends his original claim or starts again and writes off the first court fee.

    As regards anyone else spotting the error, well if he hadn't submitted the original statements how would anyone else have known he was working from someone else's account?

    It's a DPA matter. Go to the ICO, there's a helpline to call for more info.

    It appears that Natwest have sent them only some of their own statements and some of someone elses too.

    BTC you should inform the Natwest and the Information Commissioner of the breach of security, and the media would be pretty interested I should think too. :)

    Yer, mistakes happen, but unfortunately with identity fraud a big concern, it's a significant breach of the Data Protection Act. As Twinkly says, of course let NatWest know. Who else you inform after this is up to you.

    I work for citizens advice and help a lot of people claim back their charges.

    Earlier in the week i had a client in the same situation - she had recieved all of her own statements but also the statements of someone else who shared her name.

    We contacted the local branch to ensure the accounts weren't linked (in case it affected the clients credit score) but also amended the letter we sent requesting back charges, basically threatening to go to the IC if charges weren't refunded. I guess some people would call that blackmail but if it gets the clients £1300 back i have no problem with it. Whether it will work or not i don't know...

    I am in the process of reclaiming my bank charges for my current account and credit card. However, I am at the stage with mycurrent acct whereby I will be taking my bank to court.

    Originally they ignored my requests for my statements on my credit card, then on Thursday i receiveed correspondence from them- except instead of my details, they have sent me TWO OTHER CUSTOMERS BANK DETAILS one in the form of a cheque and bank statements of another customer going back to 2002!!

    This is a massive breach of data protection- can I use this as a bargaining tool to get my charges back without going to court, also should I report them?
