Right. I have followed all the stages to reclaim £260 for Cap1. MCOL issued 06/02, Cap1 acknowledged 09/02 and as of yet I haven't heard anything else, other than the court sending me a paper copy stating that claim has commenced.
What is the next stage? when do I need to submit further information to the court??
Just wondering the sort of timescale as was made redundant two weeks ago and Cap1 have today sent the same initial offer of £152. The money is tempting, but I can afford to hold out to reclaim the whole lot.

Yeah good on you. They know they are going to pay you, but they do try and intimidate some people. When I phoned the bank when I got a reply from my 1st letter, I phoned them and was very nice to them but also forceful in my actions. They know they are fighting a losing battle, and all they are trying to do is put some people off, and it will probably scare a few people off. JUST STICK IN THERE EVERYONE. As you can all see if you read through the forums, follow the advice on the site and then sit back and wait for your money.0

I successfully reclaimed my charges from Halifax some months ago, signed a letter to agree to the settlement. A few months ago, through no fault of my own my account went over the overdraft limit and again I was charged by the bank, once for the overdraft and again for a DD which wasn't paid.
If the whole argument is that the charges are too high and unfair how can the banks continue to charge at the same rate? They've already admitted (albeit not formally) that their charges are too high which is why they refunded part of the charges in the first place....
Has anyone tried to claim charges a 2nd time from their bank? Would be interested to hear from anyone else in this situation...0 -
Capital have refunded me £90 (£80 IT stated in the letter). Difference between charges then and charge now.
I am claiming for £200 and sent a letter 2 weeks ago saying i will only accept as part payment and without prejedice.
I rang them today after not hearing from them and they said on the phone they have already refunded their final offer. I argued that it was not final on my part as i only accept it as part payment. They say thats all they can do.
Now... Do i start court claim? and do i reclaim £110 plus interest as they refunded £90.......or
Do i claim for what they have actually said (That they will refund £80) stated in the letter??
Thanks0
