If you have a criminal record, can you still claim JSA?

My lastly employer. I worked as a support worker for 10 years, my conviction was only 3 years old at the time. (although it was only a minor one).

However I am having trouble getting jobs now. Many won't even give me a chance.

So I suppose not many in todays job market.

I don't entirely get it-he was convicted while employed, then went to prison? I can't imagine he'd be the first prisoner to require benefits, so I assume he received advice while inside?

I know someone very slightly who worked with children and who has a conviction for internet-type offences. There is no suggestion that he actually assaulted a child though clearly he will never get a job in the same field again. He wasn't sent to prison (the judge actually said with those sort of crimes, prison just enables like-minded types meeting and swopping methods). So he's on probation and, I guess, has various conditions attached to his freedom. But he's not actually going to be anyone's dream employee (age isn't on his side either). In cases like this (not unique, I would imagine), I can't really see what the state can do except provide benefits unless we really want criminals to starve to death.

Remember - it's considerably cheaper to give someone housing benefit and JSA than keep them in prison.

As Barbara says, not everyone convicted of child related offences goes to prison. One of my neighbours was convicted a few years ago and he certainly didn't go to prison.

I see you say "convicted of" not "guilty of"; and wisely. Some convictions have been overturned, conclusively -- after the accused persons had spent quite some while in gaol, being treated as child molesters are, there.

An old neighbour of mine living with his parents was claiming income based JSA whilst having above the savings amount in his bank. He had to go to court pay the overpayment back & ended up with a criminal conviction. I remember him begging for them not to take it to court as he feared he would never get a job working with children again due to a fraud conviction, he was a qualified teacher.

I saw his parents before Christmas & they told me that he still isn't able to find work as although his conviction is spent it will always show on an enhanced CRB check. So he back then was claiming just JSA at £55 a week now fast forward 10 years he is claiming much more in benefits. He's sadly given up on teaching & resigned to living a life on benefits, because he's unable to get work.

hmmm, but the thing is, just because you have a conviction, it doesnt REALLY mean you are different.

how many of you guys have been in a fight / gave somebody a punch ETC...

it simply means you havent been caught/convicted...

do you suggest that EVERY CRIME warrants the loss of a job?

OBVIOUSLY, there are crimes where you wouldnt let the offender go near your kids etc... (schedule 1 offences - crimes against somebody under 18 / and abuse/theft from elderly ETC)
but the vast amount of jobs out there wouldnt give an "offender" chance to effect the welfare of kids...
jobs which allow such chances require a CRB check - enhanced disclosure... and even if a criminal record is shown, its still discretionary whether the candidate is employed or not... - with a manager completing a risk assesment... (obviously, there are some convictions which do barr/exclude you from working with children ETC)

IE: kids go to mcdonalds... but would you REALLY let your kids wonder off in a busy fast food joint? - if so, you should be a better parent (you see it all the time, parents sending 3/4/5 year old kids up to the toilet on their own... but really. in this day n age... who in their right mind would let their kids walk off. potentially opening them up to abuse/kidnapping ETC)

i remember as a kid, i used to go down the road to the shop on my own (about 6 years old) but i would never dream of letting my kids do it... and im not too sure i would let my kids walk to school on their own - even high school...)

Exactly, OP isn't concerned for his relative, as others have tried to say, OP just doesn't think it's right that he should get JSA ...
