Tesco Refunded me in error and are chasing payment!

Why should it be right for you to get free stuff from Tesco's when the rest of us have to pay for it?

Cough up, trying to justify why you dont want to pay them with such feeble, weak as water reasons is not going to change the fact you have an item that needs paying for.
That they have sent you a message regarding a January payment, would in any normal persons eyes, be enough to conclude they have a record of it.

This is not a morals issue (Morales is a Mexican boxer btw) or about "doing the right thing". It's purely a contractual issue. OP, you owe Tesco ful stop and they can chase you for this for up to 6 years. Pay up or you may find yourself in court.0

If your wondering if you legally have to pay for it, then yes you do. It has already been said that they have six years to chase you for the money, debt collectors could follow your refusal to pay and your credit file could be be affected. They won't write if off they will just pass it to their legal department, depending on how many people this happened too the sums could be huge, not something they will write off easily.0

Um not so sure a court would be so sympathetic with Tescos. The OP paid collected the item and then tescos, out of thier own stupidity refunded the payment."Save the cheerleader - Save the world"0 -

Whether they would be sympathetic or not isnt the issue. Legally, the OP owes the money. If tesco have asked him to repay and he refuses........the court is not going to be sympathetic with the OP. There is no doubt in my mind a small claims would side with tesco in this. And if it ever went to small claims, OP would then be liable for costs involved.
It may not have been stupidity that caused it. There is a chance the system is automated and because the PDA's were broken, it automatically refunded payment. It could be that they were simply "holding" the funds and that the funds were never actually released to tesco.
Whatever the reason is irrelevant. OP agreed to pay xxxx in exchange for the item in question. Retailer has completed their obligations, OP has not completed theirs.
