it says the winner will be announced, not notified
isnt this the type of stuff folks take not of when they enter?

Their T&C's on the website state....'post your answers on our fb page and remember to like us so we have a way to contact you if you win'

On the FB page, they claimed to have tried to contact but could not get a message through

They said they could not send me a message. I did ask them why not as my profile is public so going onto my profile page and clicking the message button was an option for them....but they didn't respond.

I hope that the next winner won't get abuse from other people if they win and decide to keep both as they won the comp fair and square. I also hope that the people who run the competition don't get any abuse as they may think twice about running competitions in future.

Lets just hope that we can appeal to Monkey's sense of goodwill and lastkiss will get her prize.

I would hate to see that happen, and would hate to think that I had any small part to play in that if it did. Anyone that wins a competition does so fair and square and doesn't deserve abuse - if Monkey tell them they have won 2 ipads then that is absolutely what they should get.

While I also agree that companies should not get abuse for running competitions (some cheating etc comments you see on fb when winners are announced are just awful) I also feel just as strongly that they should comply with guidelines and give people a fair chance to claim their prize. After all they are running them for publicity, so it pays them to do it fairly and to have positive feedback from that.

  • I received no response from Monkey either from the website or from the personal message I sent on fb, even although there was activity on the page for some time after.

I looked into fb competition guidelines (having been completely ignorant of them before this) and found clear guidelines from IPM that back up the fact that Monkey acted incorrectly by not informing me personally and also by not giving me 28 days to claim given that it is not a time-sensitive prize.

I have written an email to IPM setting out the details and asked them if they can give me any help or advice. I'm sorry I had to do this but I really do feel that I have been treated unfairly. I followed their t&c's (such as they were) to the letter, and won fairly. That I wasn't told I had won or given any time to find out for myself and make a claim is just not fair.

Thanks again everyone that has commented here and also on the fb post on Monkey's page, I really do appreciate the support and would absolutely do the same for any one of you if you found yourself in this position. As Blulu said we are a community, and one that I love and feel proud to be part of - especially at times like this when you realise just how many people have your back.

Hope you all had a wonderful xmas :)

    Facebook guidelines

E - i. Promotions on Facebook must be administered within Apps on Facebook.com, either on a Canvas Page or a Page App.
ii. Promotions on Facebook must include the following:
    a. A complete release of Facebook by each entrant or participant.
    b. Acknowledgment that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
    c. Disclosure that the participant is providing information to I]disclose recipient(s) of information[/I and not to Facebook.
iii. You must not condition registration or entry upon the user taking any action using any Facebook features or functionality other than liking a Page, checking in to a Place, or connecting to your app. For example, you must not condition registration or entry upon the user liking a Wall post, or commenting or uploading a photo on a Wall.
iv. You must not use Facebook features or functionality as a promotion’s registration or entry mechanism. For example, the act of liking a Page or checking in to a Place cannot automatically register or enter a promotion participant.
    v. You must not use Facebook features or functionality, such as the Like button, as a voting mechanism for a promotion.
vi. You must not notify winners through Facebook, such as through Facebook messages, chat, or posts on profiles (timelines) or Pages.

They should certainly have found another means of contacting you ;)

I have messaged her Tamalyn with the IPM guidelines, and told her I have contacted them. Maybe if she does too it will add more weight and ensure a good outcome for both of us...fingers crossed.

    Thanks xxx

Thank you so much grannybiker, for this and the post on Monkey's page :)

I also found this from the IPM guidelines...

If they don’t use an App, and you miss their private message or wall post, then it’s them at fault rather than you...and...

The IPM best practice guidelines state that promoters should give at least 28 days for winners to claim prizes that aren't time-critical.

These two excerpts alone are enough to show that Monkey are in the wrong, so I really hope they will take my case on.
