blue badges & parking tickets.

Posted in the wrong forum earlier...

Was parked in a spot yesterday which turned out to be a "permit holders only" area. We wasn't aware of this. Yes ignorance isn't an excuse, but not being aware of it is the reason we were parked there.

So for starters, i don't even know whether a blue badge bypasses this or not. If not then there's going to be no joy.

If it does however, then we were dropping someone off at the train station. We took 10-15minutes tops.

Return & the parking ticket is on the floor on the road between the kerb & my drivers door. Open it up & sure enough - it's mine.

That's when we have a look around & spot the small sign on the post saying permit holders only. Gutted.

Thing is, when my mum chucked her badges on the dash, they must've fallen off as they were on the floor when we got back. Again - our/my/her responsibility to make sure they're on display, yes.


Just a question as to whether it's worth an appeal on the blue badge??


For those who are of the stance - no, you were naughty, you should pay the fine, in fact you should pay the fine tenfold you menace to society you!.....

....Her friend has successfully appealed many parking tickets over the blue badge. She often just puts out the timer section & not both sections - so she gets a ticket as per the ruling. She appeals, sends in photocopies of her badges & wins, every time.

So i just wondered if it's worth a punt?



IF so, then i have 14 days in which to pay £35. Beyond this it jumps to £70. If i appeal am i still governed by that 14 day window, or is that put on hold while the appeal is heard?

    Who issued the ticket ( very important)
    Does it mention anything about a railway by law ( usualy bylaw 14) - also important.

    Without the answer to the above a reasonable answer to your problem will be hard to find.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    You really need to get up to speed on what the BB allows, and the requirement to display. From what you describe, it appears rather chaotic and will ultimately prove to be rather expensive.

    Private car parks may offer facilities for disabled users, but this does not always mean free - just positioned better and possibly wider. You need to check the payment machine to see whether BB uses are exempt.

    Some councils will require a 'clock' and limit parking to an hour - you set the cad to your arrival time and it must be moved (not reset) at be end of that period.

    Councils will usually allow 1 waiver for non display, but will rarely make a habit of it.

    Lancashire County Council is at the top of the ticket. Some of the ticket is hard to read as looks like some paper has been ripped off.

    Penalty Charge Notice written under that.

    I can just about make out the PCN Number.

    I can just about make out it says the motor vehicle was seen on [street]

    From/At: 10:07 to 10:12 it says.

    We must've just missed the guy both ways, as we parked up at 10:05 & the train was 10:15, so we'd have made it out back to the car around 10:20 no later.

    By Civil Enforcement Officer: ### Who believed the following parking contravention had occured:
    Parked in a residents' or shared use parking place without clearly displaying either a permit or voucher or pay & display ticket issued for that place.
    Contravention Code: 12

    There is no pay & display up that street. There's no pay machine at all.

    Yes, the blue badge should've been displayed properly & we should've made sure of that - we're not arguing that

    However if the blue badge is irrelevant & we'd have got a ticket even with it, then this is a pointless question. If though, had it been displayed properly, we'd have not got a ticket, then i wonder if it's worth an appeal.

    I would advise for further information etc you pop over and register on pepipoo, dont pay just for the sake of it as most council tickets can be successfully appealed.

    Registering is free, you will need to post your ticket on there either by scanning it or take a photo of it - remove personal details though.

    Please also bear in mind that it is the holiday season and it may take a while to get replies, if you find that then bump it to keepiton the first page. Keep an eye on the deadlines as well but what ever you do dont ignore it.

    I suspect that you suspect it says residents only - to which you'll likely then say "can't you read the sign"

    Yes, it is a residents/permit holders only sign.

    Why did you not just park on the double yellows, rather than take up a bay? Blue Badge & clock allows this for 3 hours, as you'll know from your Mum's BB book.

    Anyway, best advice is to go to pepipoo and get help to appeal it:

    It is ALWAYS worth a punt in appealing any Council parking ticket. Obviously if it had been a private one in a car park you could have ignored it but this one needs an appeal).

    Many Councils have a policy of letting people off the first error when they get their first PCN with a Blue Badge displayed.

    It's easy saying things now. If i'd have known about the permit only then i wouldn't have risked parking there. It's easy saying afterwards. I just drove to the top of the hill & parked up as it was closer to the station.

    Anyway just posted on that other forum. Scanned the ticket.

    It's a good job i can make out the bottom PCN number otherwise i'd have no chance of paying. Here's how i got it:

    Pepipoo will need the back as well. Small print is often flawed.

    The fact that the front is illegible is worth including in your appeal as well.

    Also what did the sign say EXACTLY? Was the word 'residents' on the sign, or just 'permit holders'.
