Dear Mr Butler,
I am writing to complain about a release of my data to Civil Enforcement Ltd from whom I received a "parking enforcement notice" this morning.
Please find a scan of the invoice attached.
I wish to make a formal complaint about this company in regard to a vehicle registered to me being parked in a CE operated car park on behalf of the Co-op food stores.
This vehicle has never at any time been parked for longer than 30 mins at this location and as you can see from the scan they have in my opinion fraudulently logged the arrival and departure of this vehicle from 11.52 to 17.05 hours. This is not possible.
The vehicle was parked for approx 10-20 minutes at lunchtime and then the vehicle returned to the Co-op about 17.00.
They have deliberately falsified the invoice for their financial gain. This is not an issue about whether they have the right to demand monies for parking infringments as there was no infringment at all.
In my opinion they have committed fraud to demand money they have no entitlement to. That is a criminal offence.
As this is a 2 hour free parking car park they have suffered no loss at all and they can only claim for loss or damages on this basis.
So even if this vehicle had overstayed which it clearly did not,they have no case to bring in regard to this location.
I also wish to complain about and draw your attention to the poor communications in their "invoice" which to me is masquerading as a Penalty Charge Notice such as no visible private company name,no appeals procedure which should be clearly visible to the recipient and finally threatening the recipient that unless this "fine" is paid within 14 days the details will be passed to a debt collection agency and "further costs may incur". This is another threat that is illegal as there has been no financial loss to themselves so there is no "debt" to collect and they will no full well that civil debts not enforceable through the courts cannot be recovered through the courts by a debt collection agency.
To imply legal action will be taken even as a possibility to intimidate citizens into paying for anything that is not legally enforceable is a criminal offence under the Justice Act 1970.
Clearly here,the invoice is designed to frighten and intimidate the recipient into paying an invoice they are not legally required to pay. Furthermore their details are buried at the foot of the invoice in small print which many people may struggle to read.
They are in breach of the BPA code of practice and I would like to know what action you are going to take against them.
I look forward to your reply and what investigation you will take against this company and to the outcome of that investigation.

You ought to include the fact that their request for your details was made without due cause, and was therefore in breach of the DPA. The ins and outs of the business practices of a company are not strictly the DVLA's business, but unjustifyably selling your details is.0 -

Just an update.
I have decided to write to CE Ltd simply to ask for the POPLA code as advised on MSE.
I am so furious at their blatant fraud RE logging my 2 visits from lunchtime to late afternoon as 1 visit and fraudulently billing me with their fake invoice.I want to make them pay for the POPLA appeal. I don't care what POPLA say. I will ignore from them from then on anyway.
I also wrote a very detailed letter to the CEO of COOP food stores explaining why I won't be shopping at COOP anymore until he sorts out this fraud and that COOP are co-responsible as the landowner for any harrassment I receive.
And I have written to my local MP at the House of Commons,the local Trading Standards Service and my local newspaper. I have copied the letter I sent to CE to all of the above.
I have also sent my written complaint to DVLA for CE requesting my private data without due cause and falsifying the time clocks on the invoice (Fraud)...
I will let you know of all replies I receive.

Just come back with what you have for the popla appeal, maybe we can give you some pointers?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

no reply yet re POPLA but just realised that as a member of the Co op (the members shopping card) the fake invoice was in a sense sent to one of their employers.
I pointed this out to the CEO of Co op in my letter and reminded him of the companies "ethical" reputation and of it being tarnished on consumer forums by his association with parking firms who conive to cheat and harrass his customers.
I mentioned MSE and invited him to come and browse the forum to see for himself the depth of anger felt by customers over this issue.
I'll let you know if I get a personal reply or the standard fob off.0 -
The thing nobody mentioned yet, and fully explains the issue is 'incompetence'.
ANPR kit has no malice, and if it misread a drive out, then the resulting claim is erroneous, nothing more. However, assuming anyone cared to prove their innocence, the OP would need corroboration that their vehicle was elsewhere during the period the PPC were claiming it was with them. Not always easy to do.
The DVLA are required under the DPA to supply details to anyone TA asks for them claiming a reasonable cause. So working up a frenzy over this is pointless.
Shop elsewhere, and ignore. Life is too short!0
