To make it better, they are actually trying to argue and say the "money may have been uplifted but won't actually be removed from your account, and will drop back in within 24 hours"... It's there on my statement in black and white and has gone out to Debenhams! Very annoying. Bad enough it's been reserved funding since Friday, effectively by the time they admit it and resolve I will have been without access to my own money for the best part of a week! :mad:Still looking for the plot...... Anyone seen it???0

Debenhams T & C state clearly (several times!) that the contract is only formed at point of dispatch.
A company's T&Cs do not supersede the law of the land, though.

Yep same here. :mad: Although i paid via credit card so it's not actually my money. Although if they do not hurry up and refund it will be on this months statement and then i shan't be happy.
They tried to tell me that it hasn't actually been taken blah blah blah, i let him try and explain and then at the end told him that "No! Debenhams have actually taken the full amount out of my account, not pending or reserved actually been taken.
I still do not think he believed me and thinks i have no idea what i am going on about.
Hopefully it will show up in a few days or else i'll be back on the phone.0 -
Tara747 I'm wondering this too. I've been in this situation before, the money was held for 30+ days before I threatened taking the case to the body for distance selling.
As I recall it they are within the law (under distance selling regulations) if it goes like this.. (which it has!)
The money is taken from the buyer as soon as they confirm their order, this cannot be stopped once in progress. If the item is out of stock and they cannot complete the sale the buyer should be informed immediately and then money refunded ASAP (unsure of timeframe here, but should also be pretty immediate).
Their terms generally mean nothing, if they are out of line with general law of the land. They cant just say oh yeah we will refund you within 3 months if they actually should, by law, within 1 month and then say but thats our terms and conditions.
I havent emailed or called to talk through getting my money back, I know many of people are complaining of still not having a refund 8 days on after numerous calls and emails. You need your money back with you ASAP especially if you've spent over £100+ as its a much bigger risk than a lower amount but still the lower amount counts, I'm waiting on £12 but thats still enough to sway my account especially as we are going through a difficult patch right now. Debenhams wont care about that now though. I will be ringing today, my bank, the retailer and if no luck then the body for distance selling for advice on the matter.
