Hello all,
I've been following the thread with the taxi driver and WoWoman who have been sent the private parking ticket by Pro Serve Solutions. What was the outcome for them, does anybody know? I've received the same papers for the similar location, outside Parcel Force on Ransomes Europark. £180 fine for parking for 5 minutes to collect a parcel. All the parking bays were full so I parked on the road, the signs look like they relate to the parking bays and weren't obvious to read. Anybody know if taxi driver and WoWoman had to pay up in the end? Thanks!

Do you mean Proserve got your data from the DVLA like we've heard before, YET AGAIN?
There's a complaint in about them I think, so add your complaint here:

Somehow Proserve are circumventing the requirement to be in an ATA, and getting people's data from the DVLA - I suspect by hiding behind their bailiff enforcement arm. Unlawful - and well worth a complaint to the DVLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes but if they have done it like below it quite clearly says they are a parking company, they are not in the AOS so shouldn't be able to access the RK details from the dvla. They must be in the ata otherwise there is breach of the dpa if data is released to them. The dvla admitted this in an email.

I don't know where you found the scan of that request but it doesn't say they are a PPC as they describe themselves as Enforcement Agents! They also claim to be acting on behalf of the landowner who wants to bring a claim for trespass. That would be a perfectly legitimate request for data e.g. a solicitor or anyone else acting as the landowner's agent could be requesting the details. As I said before imagine a vehicle has been dumped or abandoned on one's property.0

It's on the pepipoo link earlier on this thread, being enforcement agents quite clearly tells you what they are, and as this is a manual application it must be checked. This hasn't been done, and data released against the dpa, if you look at the pepipoo link coupon links to an email from the dvla about the release of data. This is a breach!

TBH The landowner on this particular industrial estate must be well aware and approve of what Proserve are doing so could easily request the DVLA data themselves.0

No it doesn't legitimise the request, they are a parking company, they must be in an ATA to get RK details, otherwise what would be the point of the AOS ? This is a breach and should be complained about. If the landowner wanted the RK details they must do it themselves. I don't think it legitimises the request at all.
Any non-ATA PPC could potentially call themselves an 'Enforcement Agent ' then...if you look at Proserve's website they are a PPC going by 'another name'. They then issue Parking Charges - same as any PPC does.
This one has got to be stopped, seen it on 3 or 4 threads now (Google 'Ransomes Proserve' and they are findable).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Can i ask what the outcome was for the above as i have received a £180.00 parking ticket fine for parking on double yellows, while taking my legal 45 minute tacho driving break during the daytime, after making a delivery at one of the businesses there. I was parked in a non busy area and out of the way so that i didn't block anyone!
This was a reduced fine from £250.00. I have read that a company did take them to court and Ransomes won and they ended up paying their £1000 in fines.
Unfortunately i work as an agency driver and i am 3rd in line to pay this fine... it was paid by DW Clark logistics initially and then my agency and now i am to pay this back to my agency.
I think the charge is ridiculous due to the fact that parking fines in London are cheaper and surely this is not right?!?
Are there any cases being made against them?
I have read that you can "appeal if you think the amount you have been asked to pay is unfair. Also If you are challenging the level of the fine, you can ask for a breakdown of how the landowner calculated their losses.Compensation can only be claimed for losses suffered because you parked either in the wrong place or stayed too long. For example if a company charged a fixed penalty because you stayed longer than agreed, this may prove to be unenforceable by the courts if the fine exceeds the amount of actual loss experienced by the landowner."0
