    You might be waiting a while - I'm not convinced that Proserve would have the B*ll*cks to take this to court.

    Did Proserve get your details from the DVLA or did you provide them by way of contacting them? If the former then it needs another complaint to the DVLA.

    Note that as they are not AOS members they cannot invoke the Protection From Freedoms Act 2012, and hence they can only raise a court claim against the driver, NOT the registered keeper. You are under no obligation to name the driver.

    You don't have anything to worry about unless they issue a claim, the £180 will never be accepted as a loss in a court, it's a penalty plain and simple
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I would argue the toss where the highway finishes.
    Does it have any gates or barriers from the road.
    Would the police enforce the RTA upon it.
    Could you decide to test out your off road bike ?
    race along it ?
    Whats the speed limit.
    All points worth arguing.

    The three clinchers on this would be:

    1. Who was driving? Only they are liable. If Proserve don't know this then they are stuffed,

    2. Do they have sufficient ownership of the land to form a contract

    3. £180 is a penalty, end of story.

    They won't take action with those hurdles in the way unless they are clinically stupid.

    It is private land - an industrial estate, connected to the Highway - one entrance is completely open to the highway, a second entrance has a barrier that is occasionally lowered (to prove that it is private land I presume)

    Yep, their bailiff Dept is a separate thing, only for when they act for a Court, maybe for local Councils, that sort of thing. After a Court judgment.

    The Parking Dept that you are dealing with (ignoring) are NOT bailiffs and cannot act as bailiffs in this situation.

    As suggested to the OP of this thread, you must complain strongly to the DVLA that they have circumvented the process to get the RK details. They are not members of the BPA OAS, the DVLA have acted recklessly, and what are they going to do about this abuse?

    I've been following the thread with the taxi driver and WoWoman who have been sent the private parking ticket by Pro Serve Solutions. What was the outcome for them, does anybody know? I've received the same papers for the similar location, outside Parcel Force on Ransomes Europark. £180 fine for parking for 5 minutes to collect a parcel. All the parking bays were full so I parked on the road, the signs look like they relate to the parking bays and weren't obvious to read. Anybody know if taxi driver and WoWoman had to pay up in the end? Thanks!
