Parking Eye Ticket - URGENT Advise Please

My wife has received a Parking Charge Notice through the post
from Parking Eye car park management for staying 3 hours 15 mins in a 3 hour car park which they have photographic evidence of which occurred on the 23/10/2012. The charge is for £85 reduced to £50 if I had paid within 14 days.

Many posts as well as Watch Dog say that these should be ignored and NOT pay the £85 they are demanding which is what I have done since the first notice sent on the 28/10.

I do not believe £85 is what the 15 minutes that my wife stayed over had cost as loss to the owner of the land, I would gladly pay for the 15 minutes but that is all.

They have now written to me again with a more threatening letter quoting that under the Schedule 4 of the Protection of Freedoms Act they have the right to persue me as the registered keeper of the vehicle for the £85 which I MUST pay within 14 days to avoid further action.

If this letter is ignored, further action may be taken such as the instruction of solicitors to secure immediate payment or the issuing of court proceedings which could incur further costs.

I therefore need some advice as to what to do, should I carry on ignoring or should I write with an appeal, if so can you
help me with a letter. They say in their letter that that POPLA is no longer available and any appeals should be sent directly to them!

Should I just pay them?

Please help as this is really worrying me now and I don't want to be held liable.

Thanks in advance for any advise you can provide.

Emperor - read through a few recent threads and relax. Your case only differs from all the others inasmuch as it is your car that is involved instead of someone else's.

Ignore unless it is a Council car park. Do check, and if it is, come back on here for targeted advice.

    Ignore them.

Oh - Parking Eye are lying by the way - if they allow you to appeal to them then you have every right to appeal to POPLA once they turn down your appeal.

See how it works - Parking Eye like to scam and lie to get your money !

  • Emperor, please tell us exactly what the letter says about POPLA no longer being available.

I might get myself a PE ticket when I'm next in England if they are saying that.

I think they are saying that since no appeal was lodged within a certain period, then all appeals are now unavailable. Not sure what the POPLA/BPA process says about closing the door on appeals. They may be right; you can't sensibly allow someone to start an appeal 6 months and 6 begging letters after the event.
