We rang our IFA and we hope to find a way out finally, its just one wall after another no help from NRAM, we asked about cca cover today as they are holding us to the letter we said two can play at that and its as if it was new news to them very concerned to hear we had all our paperwork from day one with offer letter and statements all with cca all over them did not know what to say to us, will look into it and get back to us same old story !0

Yes, the petition is gaining momentum and thank you very much to the author and all supporters, great work. Going forward I think we need a very high profile website with some professional digital marketing to give it mass publicity. I possess the necessary skills and would be happy to take on this task but remain anonymous. Please let me know if I would get support from all here if I put the work in. What I will need is plentiful social media exposure and lots of links to our site from other websites. We would need the site to eventually reach Westminster Cabinet level to achieve the desired effect.
A possible question to ask the FOS - How would they have reacted to a NRAM complaint had some of us refused to adhere to CCA legislation in the event that NRAM considered the contract as legally binding (in their favour). Although entirely hypothetical and I think we all know the answer but silence may well help to prove our case.

Having complained to NRAM at the start of March, I have received an 8 week holding letter, and two further 4 week holding letters. We are now nearly a week past the deadline from the last letter and surprise, surprise, nothing from NRAM. I have phoned them to ask why not, and have been informed that I will not be receiving a response to this now, as I will be included in the generic letters they are sending out in July to previous customers, telling them where they stand. However, they have also said that I will be receiving a copy of the original agreement we signed, offering us £30k, which we signed (although I have a copy of this and it states it is regulated by the CCA), so kind of shooting themselves in the foot there! My whole complaint relates to the fact that we never utilised the 30k and only borrowed 23k, but they are now ignoring this complaint, as they are writing to us in July anyway, and I have been told that NRAM do not have a time limit to investigate this imposed on th by the FOS, as it relates to CCA. Hmmm, not sure this is true in the slightest, and we have received three leaflets from NRAM regarding referring to the FOS. I'm so annoyed that they think it's ok to just dismiss my complaint now. I'm not dismissing it and am informing them of this by letter, and referring it to the FOS.0

Surely if they haven't resolved your complaint within the 8 weeks, you can now take it to FOS? I can't believe they would be allowed by FOS not to have a time frame to investigate the complaint.
Have you tried contacting FOS about it and see what their stance is on the situation? I wouldn't be taking NR's word for it and think you have exhausted their complaints procedure.0 -
I am in the process of referring it to the FOS. I certainly don't believe they wouldn't impose a time frame either. Absolute nonsense, and shocking customer service.0

Sorry just to add to this as I used to work for Northern Rock and was made redundant in the first batch of people to go.
Allot and I mean allot of together mortgage customers that have signed the unsecured paper work not only was the paperwork the exact same used as for loans under £25k, NR also destroyed the original credit agreements and prefer to keep a microfiched copy of the agreement and most of the agreement is unreadable. For e.g. on my own previous together mortgage the part about loading the unsecured by 5% above SVR is unreadable from when it was scanned into the system. I would suggest requesting a copy of the CCA and see hows your's looks and then make a complaint to try and discuss getting a lower rate by complaining. For example on mine the loan was to be 5% above their base rate but all you could make out was the 5% variable. It could mean a huge difference in interest to the loan.
NR know they haven't got a leg to stand on with this. I also know that in the case of some peoples CCA they don't have anything at all stored for it.
From my time at NR I have seen huge mistakes and one in particular was a customer taking a mortgage at 1.99% fixed for 2 years and a further 5 year tie in on their SVR. When it went to processing to send the paper work out the wrong paperwork was sent. The processing department used the wrong template and actually gave the customer a 1.99% fixed rate for 2 years with no extended tie in. Of course the customer signed and returned it and then after a month or 2 rang up to check there was no tie in at SVR to be told although a mistake with paperwork they were to be tied in. NR tried to hold them to it but after making a complaint the customer got it in writing that they wouldn't be held to it.
If I was anyone I would be asking for a copy of the information and even under a Subject Access Request as you may be able to negotiate a better rate with them because allot of their mortgages were dealt with by temp workers because NR didn't have the amount of trained staff to deal with the work.0 -
