    Don't think any cases have gone to court - if they had, they would be reported in the press.



    Worth contacting the solicitor Paul Tilley on this thread or Howlett Clark solicitors who have dealt with a lot of cases

    Thanks, complaint was filed in 2013...went to the FOS who obviously ruled in favour of NRAM
  • I complained back in 2012 when the complaints were mainly based on misselling and misinterpretation. I got nowhere too .


    Think the complaints are generally based on a case of unfair relationship now.

    Don't think any cases have gone to court - if they had, they would be reported in the press.

    Wrong. you can go to Court and get a result without having a trial.

    most cases will settle with an NDA as part of the terms, thats the trouble, so you never hear about them

    If you 'never hear about them', how do you know it's 'most cases'?

    Besides, if you have a settlement you don't go to court (that's the whole point of a settlement), and you never have a trial in a civil case, you have a hearing.

    hahaha ok play on words there but thats fine, so given i was one of the lawyers who put together the s140 cases i may have a little idea of the background and what happened etc.

    On the point about the "trial" vs "hearing" well i bow to your judgment, but it seems that of the 7 orders on my desk not one refers to hearing, but funnily enough does say "the trial " and im quite fortified by the fact the CPR also carries those points, look here for example the standard directions http://www.justice.gov.uk/courts/procedure-rules/civil/standard-directions/list-of-cases-of-common-occurrence

    If you look at the Standard multi track directions they say
    7) The trial will be listed as follows.
    a) The trial window is between xxxx and xxxx inclusive.
    b) The estimated length of trial is xx day s.
    c) By 4pm on xxxx the parties must file with the court their availability for trial, preferably agreed and with a nominated single point of contact. They will be notified of the time and place of trial.
    d) By 4pm on xxxx pre-trial check lists must be sent to the court.

    Is a solicitor looking after your claim?
    Mine started in 2017 (although has been going on since 2008 with other solicitors who gave up!)
    I've not had an offer either and NRAM are dragging their heels

    My initial complaint to NRAM by myself was rejected in early 2013 and this claim has been with solicitors from 2016.
