Feel fleeced by a 'nice'car salesman at arnold clark!!!!

Hi Folks, I have had to trade in my car I bought five weeks ago for an automatic due to a continuing health problem. I went to arnold clark and a really 'nice' salesman looked after me. He managed to get me a Peugeot 3008 for £12988, delighted with thhe car which I get next week. I only agreed the sale on Friday 30.11.12. However I really need advice on the deal. Part exchanage for my car left me with £300 but doesn't appear to have been taken into account in the finance but the arnold clark £300 discount has !!!! However being totally satisfied with the monthy payment on PCP I agreed to the sale. The balloon payment at the end of the agreement was quoted as £4695, no problem. Saleman returned, "how does thsi sound, we really want your business so for an extra £4 a month I can add VRI insurance, a service plan, and one year extra warranty". I said thought that was a great deal but seemed alot for such a low payment, at no time did he tell me the total amount ffor all these. I feel so b****y stupid, the ballon paymet has increased to £5482. As AC get you to sign electronically I never noticed this and the saleman never opointed this out to me. SOrry for the long post but totally P****d off. Do I have a leg to stand on, please.:(:(

I am not an expert but the fact the salesmen didnt point out the increased balloon payment would IMO give you reason to back out of that part of the deal.

Is there any cooling off period regarding signing for finance

He did point out the payment, it was right there in front of you to check when you signed.
I'm no fan of AC, but they don't hide paperwork or blank out part of the screens. As you were in the showroom, their place of business, not your home, why would there be a cooling off period?
Talk to them again to see what deal they will work out for you, but don't go in with the belief that you've been conned, they'll dig their heels in.

From the OP post he pointed out a £4 monthly increase but not an £800 rise in the final payment.

Do you think that is acceptable

Of course the OP should have checked but equally the salesman should have pointed it out

Check your paperwork. It should state whether or not theres a cooling off period.

Its kinda hard to go back to the dealers now and say 'I wasn't told that there would be an increase on the balloon payment' because it'll all be laid out in the paperwork which you should have checked. But, its still a huge failing on Arnold Clarks part not to have mentioned this clearly to you. Id still go back to them and explain that the finance terms were not laid out clearly at the point of purchase and you have some concerns in the way in which it was sold to you.

There will bve no cooling off period as the customer has entered the business premises on there own free will, no cold calling or distance regs will appy. You have signed a contract on premises so you will be at the mercy of AC goodwill and grace. AC will think that it sounds like buyers remorse. I hope that you do get it sorted to your satisfaction.

The above tale is one reason why I never enter into garage finance or PCP agreements, you end up negotiating a monthly payment and not the price of the car, confusion reigns and you end up being done over.

OP, do you know how much the car has actually cost? Was it £12,998?

Not sure that is the case for in store deals, more fool the OP for thinking the 'nice salesman' was in it for anything bar their monthly targets :o

the finance agreement could be cancelled (from feb last year) but you cant cancel the sale agreement as it was signed at the traders premises.

So in short no you dont get 14 days to cancel...I have been exploring the net this morning

Not sure we will see the OP again though...7 posts in 5 years, but hopefully he will return and update

This highlights the amazing deficit that people have for probably, their second highest value purchase. Even sensible people looking at shiney new metal are easy prey for the most obvious sales tactics. If you went in to your local and were presented by an offer of a pint for only 10p (per week over two years) you'd chuckle and move on. High value car sales are swayed by "reducing" the payments like this (often inflating any balloon/right to buy payment) to their monthly or weekly equivalents.
It's all there in black and white, with all of the key figures highlighted, but most people zone out and look at the key figure that has verbally sold them the car.
I've sold cars to people that only sub-primers would offer facilities to and I've highlighted the apr and still they've taken the deal. Why? because the box they were interested in, the £25/week or whatever suits there needs.
Keep your wits about you, ask for a copy of the deal to consider (they wont give it to you citing confidential paperwork etc., this is where your cameraphone comes in handy) and look at all of the deal. Don't however say you didn't know. That wont cancel any deal as it will be recorded for all to see.
