Beko Tumble Dryer Manufacturer Recall - rights

Dear All,

I wonder if someone might be able to pint me in the right direction here.

I recently purchased a beko Tumble dryer (beginning of OCT 2012) and have recently discovered that there's a manufacturer fault (described on Beko's website currently) which could lead to a fire. Beko offer a modification to rectify the fault.

My question is this:

Can I ask for a replacement model rather than have the existing model modified?

I don't want a modified dryer that has a potential fire hazard.

I purchased it less than 2 months ago and used a Credit Card.

Do my consumer right entitle me to a refund or replacement?

  • No, you have no rights to a refund.

    Under the Sale of Goods Act, if the item is not of satisfactory quality, the remedies are repair, replacement or refund. Generally the retailer gets to pick the cheapest option, which in this case will be a repair.

    However, there is a condition that a remedy must not cause you significant inconvenience. So if the repair is going to take (say) a month, you may be able to get a refund instead. However it'll take you longer to get your money back than the repair would take in the first place...

    Surely if they modify it to rectify the fault then it wouldn't be a fire hazard?

    My mum had a Bosch dishwasher that posed a fire risk (they were all recalled), they came out to rectify the fault and when the technician opened it up he said hers was fine and she'd been at no risk, but he carried out the modification just to be sure.

    They could have asked for a refund, however as said above, the retailer is *highly* unlikely to give them this, as a simple quick repair will sort the issue.

    Edit - Any reason why you have 2 accounts on here, crazygeordiegirl and bb169 ?

    Unless (as Vuvuzela suggests) you have two accounts...

    The option for repair, refund or replacement is at the discretion of the RETAILER not the PURCHASER by the way.

  • Have received a product safety notice from Beko. I purchased my tumble dryer in October. (slow response from Beko). I was told on Friday that I would hear from their engineers in a few days. When I complained yesterday re no phone call I have been told thay will now be contacting me within a month about the repair.
    When I asked to speak to the repairs dept they informed me that I could not and the phone called ended.
    Customer service from Beko is appalling. I will be boycotting this company from now on..

    I had the same thing, even though the dishwasher was now 10 years old by that time, not much of a risk then. At least I got a bonus of a 12 month warranty from the modification work.
