  • People on here are correct, the Railway Bylaw 14 is a strict liability offence and is dealt with in the Magistrates court.

    My client's case concerned 3 x £90 penalty fines following parking at Staplehurst train station. ( website was down hence wasn't able to purchase a ticket) My client attempted to appeal but that proved a fruitless waste of time hence I advised my client to pay the £270 in fines and then issue a N1 claim form to recover the money, stating the train company is not complying with the relevant Statute and charging penalty fines is unlawful. The claim was issued and there was supposed to be a final hearing on Feb 26th 2013.

    Unfortunately, the claim was settled in full by South Eastern, days before the hearing, without having the case tried in court. However, given my extensive experience in court proceedings concerning consumer related claims, I was very confident of success. Some of my court wins are listed at moneyclaims4u.

    I will defend anyone in England and Wales, free of charge, in civil parking charge cases. All I ask is you make a donation to 'Help for Heroes' after the case is finished.

    I visited Cheshire Oaks Discount Village at Christmas and along with a multitude of other cars parked on a grassed area as there were no other parking spaces; there was nothing to say 'no parking'. I ignored the original ticket thinking they were scammers but have now received a notice saying if I don't pay £100 in the next 14 days, the fee will double.

    Please advise.

    Of course they are scammers, what on earth makes you think anything has changed? Everyone gets those letters, it's part of the whole mail scam.

    1. Complain in writing to Cheshire Oaks management about this inexcuseable treatment involving threatening letters (enclose a copy) being sent to genuine customers who shopped at such a busy time as Christmas. Tell them how utterly disgusted you are and that you intend never to return and to tell all your friends about Cheshire Oaks allowing a parking agent to threaten customers and pretend they can 'fine' people when thay cannot.

    2. Read this forum, it's all a scam, a fake PCN con outed by Watchdog several times and on here ad infinitum every day. :)

    That thread has all the info you need, whichever PPC issued the fake PCN. Just play snap with the letters against the 'PPC letter chains' thread (the PRE-OCTOBER pics).

    Thank you Coupon-Mad; it really is worrying when you receive a 'Formal Demand'; the Company is Care Parking. I will take your advice and will write to Cheshire Oaks management and file the Formal Demand in a drawer!

    As you will see, Care Parking sometimes use 'Thomas Higgins' letters - but sometimes these companies ring the changes to try to catch people out and scare them! If you get Roxburghe or Debt Recovery Plus or CCS Collect letters instead just ref to that link again and look for the pics shown under any other PPC which uses that threatogram chain.

    I have ignored 2 fake PCNs and would happily collect more - they make me laugh!
