I parked in error on one of the hatched spaces which was an honest mistake as I didn't see the markings until I came back to the car. I was issued with a £75.00 ticket. I explained that it was a genuine mistake, the fee was disproportionate as parking is free at Bluewater, and that the particular space caused no obstruction or hazard to pedestrians, other vehicles, etc etc. I got sent photos of my car parked in the space, and in the background was the parking company's van....in a hatched space!!! They said that the space was hatched to ease congestion, and loads of other waffle......but should I swallow it or ignore it?

As a consumer lawyer this outfit is one of my next cases I'll be taking on. Having taken care of London and South Eastern in a Railway Bylaw 14 car park penalty charge test case last month at Maidstone County Court I am looking forward to seeking redress in this matter.
My view is, as was with the case with car park penalty charges at railway stations, penalty charges are applied in 'terroreum' i.e. aim to frighten someone to pay and are therefore not enforceable in contract law. My advice is do not pay Parking Control Management any money.

How is a bylaw 14 ticket going to a county court ? Normally they go to magistrates court. And there is a huge difference in a parking charge notice that is based on contract law and a bylaw 14 that ain'tWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. By laws are indeed magistrate court affairs
And they are not test cases

POPLA appeal reason 1.
There was no mention of anything regarding hatching on the signage and, seeing a PPC van parked there (see photo), I believed it to be a valid parking space.0 -
I think that member has posted before under a similar username and is a lawyer with useful information. Give him a chance please, I am sure I recall him. It would be especially useful to hear about the test case as Railway Bylaws tickets are a headache even on pepipoo where we sometimes tell people to pay.
