Bought car from dealership 3 weeks ago under warranty-advice please!

I am absolutely livid! This morning after some arguments on the phone they have come and collected the car and taken it to the workshop but this leaves me in a messy predicament!
To explain, I bought this car from a dealership on 2nd November. It had a new MOT and service done just before hand and I was told I had 3 months warranty and I also took out the extended warranty because the vehicle is not a common make and knew the parts would be expensive should it need repairs. Everything was fine until last Sunday when the warning lights came on for the Traction control and ABS. I went straight to the dealership as I was driving in that direction and it is literally around the corner, when it happened. They said call the workshop which happens to be in the next town, 20 miles away. I called Monday morning and told me the earliest I could take it in was Tuesday. I took it in Tuesday and they said it was a faulty traction sensor on the left wheel and would order the part but would take 4 days to arrive. I am busy next week as my mother is visiting and will be driving about so asked if it was safe to drive and booked it in for the Monday after she leaves. The mechanic said there is no problem driving it. Last night I took my son to work 2 miles away and on the dual carriageway it didn't seem to want to accelerate. When I got home the front wheels were smoking and really hot. I am guessing the brakes have seized so called the workshop straight away. Ok so it was 5:15pm and I explained what had happened and promised a call back. No call so I called first thing this morning. I was told to take it to the workshop. I argues for my safety and was told to get a recovery truck. How? Why? I then called the dealership and went mad. They said they would take it in the afternoon but the workshop closes at midday. I asked how they can leave me without a car? We don't provide hire vehicles. Excuse me. What is the point of a warranty if they are not going to assist where they are at fault? Surely if the service and MOT had been done properly a fault with the brakes would have should up but there were no advisories on the MOT. Now the dealer who picked it up said it must be the ABS. That I feel is a cop-out as the warranty does not cover brakes, but what about the MOT. Also I read the manual and it says not to drive the vehicle with a traction fault and if the ABS fails the brake warning light will come on, which it hasn't. Bearing in mind I have only driven 50 miles since I took it to the workshop I don't know how they can say it has developed another fault. Now I am waiting to hear from them but I just know they will either leave me stranded or find some way to charge me. Admittedly, by arguing I got them to pick it up as I refused to drive it in that condition but I am preparing for an argument for their excuses. I have threatened going to VOSA about the MOT and demanded a full refund today of they do not sort the problem out but being the make of the car, any replacement parts will need to be ordered. I am already missing a class for my degree today as a result and now will not be able to pick my mother up from the airport on Monday and spend the week driving around visiting places as planned. Surely, they must be liable for the inconvenience caused and offer me a car to drive in the meantime?

  • Use sales of good act and get your money back ASAP and don't take no for an answer.

    Tell them you'll take the car back and you want refunded as soon as and ask for a goodwill gesture aswell for your inconvenience.

    That is seriously difficult to read without paragraphs but some details of the vehicle, make, model and year may help and what sort of dealer, main or Arthur Daley.
  • Bugsy- thanks but that still leaves me without a car. I had been looking for a car I could afford (I paid full amount-no credit) for a month before I found this. I P/Xed mine in and since I work late in a place outside of town I would have no way to get home other than by taxi.

    It is a Chrysler PT Cruiser Ltd with 82,000 miles.

    Threatened with VOSA? On what grounds? You have used it for 3 weeks without issue. As the MOT only applies to parts being in good order on that day your not going to get anywhere with that.

    Used car warranties are only good for the warranty company and hamsters.

    Its usually down to you to get the car back to them. get breakdown cover. get a good one also. You may need it more often than you think.

    Cars develop faults. Some more than others. A focus would have been a better bet.

    On what basis are you expecting her to be able to get her money back?

    And can you point me to the statutory law that says she entitled to compensation for her inconvenience?

    Oh and if Bugsy can answer this please, rather than some other internet expert. I'm curious to know what his actual understanding of the law is.

    Fortunately parts for the unloved PT aren't super rare so even replacing a caliper and the abs sensor VOR shouldn't be a long delay for parts and easily replaced in an hour.
    Unfortunately, unless they promised a courtesy car (cant think of many second hand traders that do), the problem is it is the weekend.
    Don't waste time and energy on VOSA, picking holes in the rest of the car or belittling the MOT. The car just broke down, just like all cars do.

    Have to agree, though the SOGA relating to used cars states that any repairs should be carried out without inconvenience to the buyer - you could argue that means supplying a courtesy car. Though an exact interpretation of that could mean that they are only oblidged to do that when the car is in for repair, ie, its not up to them to run after the buyer and give them a courtesy car at the weekend when their car breaks down as i dont think many used car dealers operate a 24x7 service (though my customers seemed to think i did). Also, i'm not sure i've heard of anyone taking a trader to court because they didnt get a courtesy car?

    Parts fail. It wasnt faulty at the time of sale.

  • The point I was trying to make with the complaint to VOSA is that it was their onsite workshop that carried out the MOT and service. At the time of the sale the saleman said 'look NO advisories' and also pointed out that the brakes, battery and tyres were not covered by the warranty.

    I would argue that a 'gross failure' like this would be because neither the service or MOT were carried out properly.

    I had to call the salesman again and he reported that the workshop had found another fault. I argued that I have only driven 50 miles since visiting the workshop and being assured the vehicle was safe to drive, so how can a new fault occur in such a short time AND NO further warning lights came on?

    He had the cheek to offer me his 'banger' to get around BUT I would need to pay for insurance to this this. I have not agreed to this and I'm currently waiting for a response for my request that they provide me with a hire vehicle as I imagine this 'banger' will break down too...
