Thank you for the OP, I never knew this but do now.

  • This lengthy discussion is mostly missing the main point -- to give a ticket for clipping the painted area of a mini roundabout is excessive. It is way down the list of potentially dangerous driving offences.

I agree that a responsible receptive person would be best served by advice.

Some mini roundabouts can get misused badly and are potentially dangerous as a consequence. One in our town was introduced as a compromise between safety and flow improvement. Its misuse has caused a couple of serious injury accidents. Complaints from the public combined with a recognition of the risk through misuse will result in police action. Often these take the form of a few periods of enforcement after an informative press release.

I wouldn't be surprised if this was just such an event.

I drove behind a female police officer who turned at a number of junctions including a mini roundabout and she never indicated once, oh and her wheels went over the white centre.

The amount of vehicles I see jumping red lights and even driving along pavements to avoid sitting in traffic is frightening, thats what the police should be targetting.

No, he's not saying the HC is "wrong", he's stating the fact of what the bit you quoted above means.

Nothing in the HC makes" law, and you cannot be prosecuted for "failing to obey the HC" even when the part you ignore is a legal requirement.

You will be prosecuted for failing to obey the legislation that makes that particular requirement a legal requirement - such as teh Road Traffic Act, the Traffic Signs Regulations and General Directions and so on.

The HC is simply a quick-reference guide to point you in the direction of what you should be doing / not doing when on the road. Claiming it as "the law" is like claiming that the quick-start card that came with your printer is the full user manual!

Yes I know all that, but how many drivers read the legislation? Practically none.
How many read the HC? Every driver at some time, and it is the go to reference for people in the first instance.

I never said you can be prosecuted for "failing to obey the HC", but if you need to know something then most/all would look at it first, there are offences in there that are referenced by the relavant infromation re traffic regs, and as said in the introduction of the HC, "Many of the rules in the Code are legal requirements, and if you disobey these rules you are committing a criminal offence. You may be fined, given penalty points on your licence or be disqualified from driving"

It sounds like you are saying we don't need to bother about the HC because "it isn't the law", if we all adhered to it then driving would be a lot better, re the OP, if they wanted to know if it was an offence to drive over the centre spot of a mini r/about, the the first place would be the HC where the answer would be found with reference to the traffic reg, they would not search out the actual traffic reg.

    That you've campaigned for?

What have you done about it?

He is a police anorak, who tries to give the impression that he is atraffic officer. Although many of his posts in other threads show that he isn't. :rotfl:

I'm guessing that being on the school run and being unable to navigate their enormous car properly round a mini-roundabout gave them grounds to do a sniff test. Having passed that, she compounded her lack of attention by failing the attitude test and was rewarded with a ticket.

    As said,,,,
Seems a bit harsh of your rear wheels clipped but the alternative is risking a big fine in court unless you can prove why it's unsafe at that roundabout.
(And some it really is but you would need to prove it)....

Plod sometimes get these ideas.... my ex used to cycle into Uni, same route every day and where the bike lane stops most non expert cyclists would cycle over the footpath...
Much as I don't approve of cycling on footpaths anyone ever cycled over Kingston bridge at rush hour knows its unsafe as its extremely narrow and as buses cross it the cars have to squeeze .... making it really dangerous for cyclists...

So one day, plod turns up and gives out hundreds of fines.

Remember, it's Christmas.... they are just looking for extra revenue? or perhaps contributions to the widows and orphans fund??? (Police XMAS party)
